Constitutional Justice Achmad Sodiki (Head of the Panel) accompanied by Constitutional Justice Harjono and Ahmad Fadlil Sumadi when examining Petition of Julianus Manusefer-Theodorus Kawer (Mekar) represented by their counsels Libert Kristo in Supiori Second Round Election case, Friday (1/4) of the Panel Courtroom.
Jakarta, MKOnline - Second round election of Supiori held on Tuesday (15/3) ended up in a case at the Constitutional Court (The Court). The initial session for this case number 34/PHPU.D-IX/2011 concerning the result of Supiori Election was held on Friday (1/4).
The file was submitted by Julianus Manusefer-Theodorus Kawer (Mekar) pair who through their counsel, Libert Kristo, sought for apology at the beginning of their explanation for not completing their data for their petition. “I apologize because in our petition there are some incomplete data; especially in number IV point 8,” stated Libert. In relation to that, Libert asked for an opportunity to make revisions in the next session.
Number IV point 8 mentioned by Libert was the data in form of numbers in an incomplete table. Libert claimed that he would cross-checked his data with the field data for more accuracy. In this proposition, the Petitioners described about the data on the distribution of voters who could not assess their rights in 40 Poll Centers. “Voters who could not assess their rights were distributed in 40 kampongs or 40 poll centers,” claimed Libert.
The panel of justices assigned to this case, Achmad Sodiki as Chairman, Harjono and Ahmad Fadlil Sumadi provided an opportunity to the Petitioners to revise their petition to the latest of next Monday at 14.00 local time.
Constitutional Justice Ahmad Fadlil Sumadi in his advice reminded the Petitioners to present six witnesses in the session scheduled at the following Tuesday. Fadlil also criticized the petitum part which among others requested The Court to give order to Supiori Commission to hold a re-election.
“Are you asking the Election Commission to hold a re-election or a re-voting?” confirmed Fadlil. A re-election, explained Fadlil, meant that the whole process had to be repeated, such as the registration for candidacy, candidate verification, and so on.
