Raja-Daeng Accused Winners of Committing Abandoned Violations

Petitioners’ Counsels, Taufik Basari and associates in the hearing stating that there had been money politics done by candidate number 4 in cooperation with the Respondent (Natuna Regency Commission) in Natuna election, Wednesday (9/3).


Jakarta, MKOnline - The Constitutional Court (The Court) held a session for the election dispute in Natuna Regency, Wednesday (9/3). The hearing for a case registered by number 26/PHPU.D-IX/2011 was scheduled for case examination. The Petitioners claimed that there had been systematic, massive and widespread violations.

The session was attended by the Petitioners’ Legal Counsels, Taufik Basari, Irwan S. Tanjung, Bernard Uli Nababan, dan Firza Nurhiza. Meanwhile, from the Respondents’ side was attended by the Principal Respondents (Election Commission of Natuna Regency-Natuna Commission), Susilawati Ramadani Barus (Head), Zahardin, Nuning Praptiwi, Harken, Januarusdi, Veri Manalu (a commissioner from Riau Election Commission). The Principal Respondents were accompanied by their legal counsels, namely Rusli, Asep Ruhiyat, Indra Halid Nasution and Zaenuri. Whereas the Related Party, Candidate pair Number 4 (Iluas Sabli-Ilmako), were represented by their counsels, Hermansyahdulaini, Abi Hasan Muan, and Ahmad Handoko.
 
Taufik Basari, a counsel for the Petitioners (candidate pair No. 3, Raja Amirullah-Daeng Amhar) delivered their main petitions. He pointed out that the existing violations were among others money politic practices by candidate No. 4 in cooperation with the Respondents to candidate pair No. 4, violations during the polling that affected the result of the recapitulation of votes for all candidates and the abandonment of the violations and the impartiality of the Committee.
 
Irwan S. Tanjung, another counsel, then described the violations. He said that on January 19, Ilyas Sabli (the Related Party) gave some money to Ali Musa (Head of District Election Committee (PKK) in West Bunguran) in order to make the half of the population in Sedanau Sub-District, West Bunguran District which had approximately 4500 voters voted for him. “At least 2.500 votes went for him, candidate pair No. 4. In detail, if Ali Musa managed to allocate 2.500 votes, then one vote would be valued 150.00 with the total of 375 million rupiahs,” explained Irwan.  
 
Back to Taufik, he then stated that the Respondents had been aware of the money politic practices committed by candidate pair number 4, but they pretended not knowing about the violations. The regional election commission were also took a side for candidate number 4 by not taking any follow-ups on the submitted reports.
  
Lastly, Basari stated that there had been massive, systematic and widespread violations. Those violations were very influential to the result of the recapitulation. It was because the difference between the result for candidate No. 3 and 4 was only 898 votes. “Every existing violation was very significant to the poll result. Because the violation committed was very serious, we beg The Court to disqualify candidate pair number four,” concluded Basari (Yusti Nurul Agustin/mh/YDJ)
