Constitutional Court Justice Maria Farida Indrati gave a short lecture to all the students of Sekolah Tinggi Hukum Militer Jakarta (the Jakarta Military Law Institute) who visited the Constitutional Court (The Court) on Thursday (4/11).
Jakarta, MKOnline – Constitutional Court Justices must be able to have a fair attitude and impeccable integrity as well as personality and must be statesmanlike with mastery of the constitution and state administration. These were the criteria which a constitutional court justice had to meet. This was conveyed by Constitutional Court Justice Maria Farida Indrati when giving a short lecture to all the students of the Jakarta Military Law Institute (Sekolah Tinggi Hukum Militer Jakarta) who visited the Constitutional Court (The Court) on Thursday (4/11) afternoon.
During the meeting, Maria also explained that three constitutional court justices were nominated by the Supreme Court (MA), three justices by DPR, and three justices by the President to be stipulated by a Presidential Decree. This was provided for by Article 18 Act No. 24/2003 regarding the Constitutional Court.
In addition, continued Maria, at least three constitutional court justices came from political parties. “However, so far I do not feel that they have a tendency towards political parties. On the contrary, they look into the problems of handling disputes in Plenary Sessions for their parties,” she explained.
The other issue explained by Maria was concerned with evidence in hearings. In substance, Petitioners may petition for review of similar articles as the previously reviewed articles. Maria said that evidence could be presented and new legal basis could be submitted which were different from those presented previously. “If it is the case of judicial review, the review is not easy because the articles are of course the same. However, other evidence is allowed, for example newspaper clippings, expert opinions, seminars and other evidence,” asserted Maria. (Nano Tresna A./mh)
