Chief Justice of the Constitutional Court Mahfud MD receives the “KAHMI Award” for his dedication, achievements and performance in the effort to enforce law and justice in Indonesia, during the commemoration of the 44th Anniversary of the Alumni Corps of Islamic Student Association (Korps Alumni Himpunan Mahasiswa Islam-KAHMI) in Jakarta, (12/10).


Jakarta, MKOnline - Chief Justice of the Constitutional Court Mahfud MD received the “KAHMI Award” for his dedication, achievements and performance in the effort to enforce law and justice in Indonesia. The award was granted on Tuesday (12/10) evening at Grand Sahid Jaya Hotel, in conjunction with the commemoration of the 44th Anniversary of the Alumni Corps of Islamic Student Association (Korps Alumni Himpunan Mahasiswa Islam-KAHMI). In addition to Mahfud MD, Sylviana Murni as the Mayor of Central Jakarta also received the same award.

On such occasion, Mahfud delivered a National Oration with the topic “The Essence of Living a Life as a State is to Have a Constitution”. Mahfud said that if we wish to live a proper, secure, peaceful and safe life as a state, we should comply with the provisions existing in the constitution in every aspect of life and life as a state.

“Constitution is actually a social, politics, economy contract and a contract of every matter related to the  life as a nation which agrees to establish the state of Indonesia,” Mahfud added.

Furthermore, Mahfud explained that if we are to live a life as a state, there are four pillars that we must pay attention to. The first pillar is the Pancasila, that we must live a life in accordance with Pancasila. The second pillar is the 1945 Constitution. The third pillar would be the Unitary State of the Republic of Indonesia, while the fourth pillar is the diversity or Unity in Diversity (Bhinneka Tunggal Ika). 

“Subsequently, the meaning of the four pillars in a life as a state needs to further explored. There would be 4 matters resulting from the exploration of the meaning of the four pillars. The first matter, whoever the person is, whatever position he assumes, is obligated to maintain the integrity and unity of the Unitary State of the Republic of Indonesia. No action should harm the integration,” said Mahfud in the event which was also attended by the Speaker of the People's Consultative Assembly, Taufik Kiemas, Constitutional Justice Hamdan Zoelva as well as other figures such as Fahmi Idris, Fuad Bawazier.

The second matter, Mahfud continued we build this country based on democracy which needs to be balanced with nomocracy or the sovereignty of law. According to the famous philosopher, Aristoteles, this is because democracy often creates demagogs or liars and narsistic people. Therefore, it needs to be balanced with the legal aspect.

“Therefore, methods of democratic decision making but violating the law, may be annulled by legal process,” Mahfud affirmed. 

The third matter, Mahfud continued, the state and its people are obligated to build social justice, public welfare, refraining themselves from living a too individualistic or selfish life. On the other hand, the fourth matter, religious tolerance, is regulated in the 1945 Constitution and International Convention. 

“Our country is not a theocratic state, therefore it cannot apply religious law. In addition, the state protects religious life, rather than applying the religion. This is what is called as religious tolerance,” Mahfud added. (Nano Tresna A./mh)
