Petitioner of Forestry Law Review Failed to Show up

Jakarta, MKOnline – The Constitutional Court held the judicial review of Government Regulation In Lieu of Law Number 1 Year 2004 concerning Amendment to Law Number 41 Year 1999 concerning Forestry, Monday (11/10), at the Constitutional Court Building. The case registered with the Court’s Registrar’s Office under Number 54/PUU-VIII/2010 was filed by Mustav Sjab.

The Petitioner and his attorney Eddy Wirawan were absent from the hearing for revised petition scheduled at 10.00 AM Western Indonesia Time. “The Petitioner, the Government or the People’s Legislative Assembly may enter the court room,” said Chairperson of the Panel Hamdan Zoelva.

After waiting for some time, Hamdan finally decided to adjourn the hearing. “Since the Petitioner and the parties did not give any notice and were absent, the hearing is adjourned until further notice,” he said.

In the principal issue of his petition, the Petitioner argued that Articles 83A and 83B of Government Regulation In Lieu of Law Number 1 Year 2004 were contradictory to the 1945 Constitution. Article 83A states that “All licenses or agreements in the mining sector on the forest area which have existed prior to the enactment of Law Number 41 Year 1999 concerning Forestry shall remain valid until the termination of such licenses or agreements." Whereas Article 83B explained that “Further implementation of the provision as intended in Article 83A shall be stipulated in a Presidential Decree.”  (Lulu Anjarsari)
