The Anti-Pornography Law Protects the Actors of Porn Video

Jakarta, MK Online – The Constitutional Court held another hearing of the judicial review of Law Number 44 Year 2008 concerning Pornography (the Anti-Pornography Law), Thursday (9/16), at the Plenary Court Room of the Constitutional Court. The case registered with the Registrar’s Office of the Constitutional Court under Number 48/PUU-VIII/2010 was filed by M. Farhat Abbas.

Through his attorney, Ahmad Burhanuddin, the Petitioner submitted the petition revised by the Petitioner in accordance with the recommendation from the Panel of Justices at the previous hearing. Ahmad added that the revision was made by strengthening the legal standing. “With respect to the legal standing of the Petitioner, M. Farhat Abbas as an individual citizen feels that his constitutional rights were impaired by the coming into effect of the Elucidation of Articles 4 and 6 of the Anti-Pornography Law,” he said.

According to Ahmad, the limitation of pornography set out in the Elucidation of Articles 4 and 6 of the Anti-Pornography Law cannot indict the actors of porn video using it for their personal interest. “The regulatory principles of the Anti-Pornography Law should not be contradictory to Article 28J paragraphs (1) and (2) and Article 29 paragraph (1),” he explained.

At the examination hearing of the revised petition, the Panel of Justices consisting of Constitutional Justice Muhammad Alim as the Head of the Panel Justices, Maria Farida Indrati and Ahmad Fadlil Sumadi as the Members validated six evidence.

The Petitioner argued that by removing the elucidation of Articles 4 and 6 concerning Pornography, the actors of porn video will be subject to sanctions, thus they can no longer hide behind the product of laws by claiming that they are merely victims. In fact, the act they performed in which the obscene scene was documented has violated the values existing and developing in the community and at the same time, reflected the poor development of morality of the nation.
