Jakarta-MKOnline, The aspiration process for customary people in Sorong and Manokwari Regencies decided as well as recommended the forming of Tambraw Regency. The customary people had provided the data and inputs to provincial government. There used to be no problems, but since the existence of President’s Mandate, there had been a change in the forming of the regency which was against the voice of the customary people.
That was the information given by Decky Rumbiak a Petitioner’s witness in the session for case Number 127/PUU-VII/2009 about the review of Act Number 56 of 2008 about the Forming of Tambraw Regency in West Papua Regency (Act on Tambrauw), Wednesday (18/11), at the Constitutional Court (The Court) Building.
Decky, a secretary in the team during the expansion process, regretted why a district originated to be a part of Tambraw Regency was expanded to be 6 districts instead 10 districts.
"There is a hidden agenda behind this, because all parties have reached an agreement that Tambraw would have 10 districts. This will create a polemic and could potentially lead to horizontal conflicts," said Decky.
Accordingly, his side had made a demonstration; however Decky regretted the Governor of West Papua for only saying to them not to worry about this matter as the central government, Jakarta, would arrange this matter.
Meanwhile, Constitutional Justice Harjono asked the Witness about the expansion process. "If previously everybody agreed to the idea of having 10 districts, was it according to the procedure or not and how about the preparation from Manokwari and Sorong Regencies related to the expansion," he inquired.
Responding to that, Decky stated that they all had supported the idea. "Clearly, whether in the Regional Parliament and in the Government have agreed and actively participated in the process," he replied.
Meanwhile, from the Government side represented by Mualimin Abdi informed that Tambraw Regency having six districts had been according to the aspiration from the Government of Manokwari, Sorong and West Papua. "We have evidence, a letter from them," he pointed out.
Mualimin then read out and showed the letter to the court. "First, in 2007, from Manokwari Regent informing that Tambraw regency would be consisted of 6 districts; Sausapor, Fef, Abun, Kebar, Miyah, Moraid. Second, from Sorong Regent informing that Tambraw would be consisted of 6 districts, but one of them was Kwoor instead of Moraid," he explained.
Mualimin continued that on April 2008, his side received a letter from West Papua Governor informing the same matter. "Then on December 2008 another letter arrived from West Papua Governor stating that Tambraw Regency would comprise of 10 districts. Still, it was too late because the enactment of the law was done by the Parliament on August 2008," told Mualimin chronologically. (RNB Aji/YDJ tr.)
