Jakarta - MKOnline, The Constitutional Court (The Court) held a judicial review for Act on Terrorism, Wednesday (11/11/2009),at The Court Panel Room.
The Panel session scheduled for examining improved petition lasted for a short time, with less than two minutes. The trial began at 11 AM with the Board of Justices consisted of M. Akil Mochtar as the Chairman, with two Member Justices Abdul Mukthie Fadjar and M. Arsyad Sanusi. Meanwhile sitting as the Petitioner were Umar Abduh, Haris Rusly, John Helmi Mempi, Hartsa Mashirul H.R.
After opening and stating the session was open to public, Chairman of the Panel Board of Justice, M. Akil Mochtar greeted the Petitioners as he showed the letter from the Petitioners submitted before the session begun. "Right before the session began, we received a letter from the Petitioners," informed Akil.
In the letter, the Petitioner stated their withdrawal for the case Number 125/PUU-VII/2009 about the judicial review of Article 5, Article 17 paragraph (1) and (3), Article 45 of Act Number 15 of 2003 about the Government Decree in lieu of Law Number 1 of 2002 on Terrorism against the 1945 Constitution.
Akil also allowed the Petitioner who wished to submit another case to The Court with other articles. As a confirmation on the originality of the letter, Akil asked the Petitioner, "Do you really want to withdraw the case?" asked Akil. "It is true,"replied the Principal Petitioner, Umar Abduh, a former follower of Imran terrorist in the Woyla plane hijacking case in 1981.
Based on the letter of case withdrawal, the Board of Justices announced that they granted the Petitioner’s case withdrawal. "Thus, your request to withdraw this case has been granted,"announced Akil at the end of the session. (Nur R./YDJ tr.)
