East Java Election Commission (The Commission) was authorized to announce the recapitulation result of East Java Election as well as the winner.

That was emphasized by the Vice Chief Justice of The Constitutional Court (The Court), Abdul Mukthie Fadjar, Tuesday (27/1), at The Court s building as he welcomed the delegation of The Commission intending to seek opinion from The Court related to the steps they were about to take following the recounting in Pamekasan Regency and re-voting in Bangkalan and Sampang Regency. At the same time, they handed over the report about the holding of the third round election in those three regencies.

Mukthie also explained that The Court was not authorized to issue such opinion, but to provide written response to The Commission s letter asking for The Court to support their next action. “Insyaallah (By God s Will) the letter will be finished this afternoon,” said Mukthie.

Mukthie continued that the re-election and the re-counting held in East Java was not the third round of the election. “It was part of the process of the second round,” he pointed out.

For that, by the law, actually The Commission was authorized to announce the recapitulation result and the winner of the election.

In a Press Conference after the meeting, The Commission explained that they had scheduled the recapitulation process in provincial level would be conducted from 28 to 30 of January 2009. “The announcement (of the winner) will be done in a plenary session on the same day,” said a member of The Commission, Arief Budiman.
