The Constitutional Court (The Court) announced that there had been administrative violations in the event of election in Greater Kubu Regency, but the violations did not significantly affect the result of votes gained by the Elected Candidate. That was announced in the trial for decision reading for case No. 63/PHPU.D-VI/2008, Monday (19/1), at The Court s Plenary Room.
Greater Kubu Election Commission (the Petitionee) had announced the votes for the Candidate No. 7 (Sujiwo and Raja Sapta Oktohari) was 90.338 votes, while Candidate No. 8 (Muda Mahendrawan and Andreas Muhrotien) got 124.738, which automaticly made Muda Mahendrawan and Andreas Muhrotein as Elected Candidate Pair. Sujiwo and Raja Sapta Oktohari then filed an objection over the announcement with the argument that there had been violations, including criminal ones done by the Campaign Team of the Elected Candidate Pair.
Answering to that, The Court stated that almost all arguments made by the Petitioner were not supported by sufficient legal evidences and could not be proved before the court. Therefore, they were unreasonable by the law and had to be put aside.
Other violations occured did not significantly changed the vote standing based on the Transcript of Proceeding made by the Greater Kubu Election Commission No. 38/BA/KPU/KKR/XII/2008 dated December 19, 2008 about the Announcement of Elected Candidate for Greater Kubu Regent and Vice in the second round election 2008, âââ¬Ã
âTherefore according to The Court the plea from the Petitioner has to be rejected,âââ¬Ã stipulated Constitutional Justice Akil Mochtar.
In the decision, Chief Justice of The Court Moh. Mahfud MD announced legal the Transcript of Proceedings issued by the Greater Kubu Election Commission No. 37/BA/KPU/KKR/XII/2008 and 38/BA/KPU/KKR/XII/2008 both dated December 19, 2008. (Luthfi Widagdo Eddyono)
