LANGKAT ELECTION DISPUTE. HEARING TO WITNESSES

The Constitutional Court (The Court) held a trial for Langkat Election Dispute case, Monday (12/1), at the Court s Building, with Verifying Improved Petition and Examining Witnesses. Case No. 66/PHPU.D-VI/2008 was pleaded by candidate pair Drs. H. Asrin Naim and Drs. H. Legimun.S.,M.Pd. Langkat Election Commission  (the Commission) became the Petitionee in the same case.

The Petitioner objected the Petitionee s Decree No. 29/2008 dated December 24, 2008 about the Announcement of Recapitulation Result in Langkat Second Round Election 2008 as well as the Petitionee s Decree concerning the elected candidate in Langkat election 2008.

The Petitioner presented four witnesses from Stabat District before the Court. They were Hafiudin, Supardi, Suparno, and Mahyudin. They testified that in the second round election, they were not enlisted as voters whereas they did vote in the first round. Besides that, there was also information about someone receiving the invitation but with mismatched Citizenship Number and the name of the voters.

Besides that, the Petitioner s objection was because the Petitionee s, in the transcript of proceeding for the recapitulation result, explained in detail only about the 409,565 total legal votes and 6,089 annulled votes buy not the number of the unused ballot. 

”The Petitionee had let several voters presumed to give their votes to the Petitioner to lose their rights because their names were not on the Voter s List and did not receive the invitation to vote,” explained the Petitioner s Legal Counsel, Hermansyah Dulaimi.

The Petitioner also claimed that the Petitionee had violated the law by inserting 69,934 voters without clear ID and their residential status was unknown also without any Citizenship Numbers spreaded almost in all election area in Langkat. The Petitioner believed that the violations occurred in 23 districts in Langkat Regency.

The trial would be continued on Wednesday (14/1), at 15.30 WIB (GMT+7), scheduled for Verifying evidences and witnesses examination. (Prana Patrayoga Adiputra)
