SPECIAL SESSION FOR LAW ENFORCEMENT IN ELECTION VIOLATION

The Constitutional Court (the Court), the Supreme Court, the Election Commission (KPU), the Election Monitoring Body (Bawaslu), the Attorney General Office (Kejagung), and the Indonesian Police (Polri) agreed on the constitutional calendar that the inauguration of members of the Parliament and City Council would be on October 1, 2009 and President-Vice President would be inaugurated on October 20, 2009, would be held according to the schedule.

That was informed by the Chief Justice of the Court, Moh. Mahfud MD, in a press conference after the coordination meeting of those six institutions which specially discussed about enforcing law for procedural and criminal violations in the election, Thursday (8/1), at the Court s Hall. All legal process related to the election, continued Mahfud, had to be finished according to the schedule. For criminal violations had to be cleared within 5 days before the national announcement of the election result by the Election Commission; therefore, had there been a case submitted to the Court, it was purely about the dispute over the recapitulation result, “because the case has been settled by the Supreme Court, AGO, the Police, and the Election Monitoring Body,” explained Mahfud.

Details about day-to-day schedule would be finished by the Election Commission, after synchronizing the schedule with the Court, so that the other involved institutions could adjust themselves. The Supreme Court had issued a regulation about election judicial with short trials and appointing special judges to deal with the election cases. Meanwhile, AGO, the Police, and Election Monitoring Body had formed a joined law enforcement center. ”This will be responsible for studying and processing criminal cases in the election fast and punctually,” continued Mahfud.

Besides that, explained Mahfud, AGO had issued a guideline for dealing with criminal cases in the election 2009. The Police had also issued an investigation operating procedure. “We are in a ready position. Do not worry about the election to fail, just be optimistic everything will run well,” closed the Professor in Law Politics. (Wiwik Budi Wasito)
