The Constitutional Court held the trial for verifying improved petition for the review of Act No. 40/2007 about Limited Company (Act on Limited Company), Tuesday (6/1), at the Court s Panel Room.
The trial of Case No. 53/PUU-VI/2008 was attended by the Legal Counsels of the Petitioners, Indonesian Chamber of Commerce, Young Entrepreneur Group and Women Entrepreneur Group, John Pieter Nazar, Iskandar Sonhaji, and Abdul Ficar Hadjar. In their improved petition, they informed that there had been several additional explanation regarding the Petitioners legal standing also in the petitum part.
The Legal Counsels considered Article 74 of the mentioned Act, regulating about the social and environmental responsibility of a company, had caused some loss on their side financially. âââ¬Ã
âThe article has caused a double expenditure to companies which ran on managing and making use of natural resources,âââ¬Ã told Sonhaji.
Besides that, continued the Petitioners, the Article had also caused uncertainty because it had dispersed the responsibilities based on social responsibility with the ones based on legal obligation.
In the trial, the Legal Counsels of the Petitioners demanded one week time to the Panel of Justices to complete their petition as well as the attached evidences. Constitutional Justice Akil Mochtar as the Head of Justice Panel Board said that the Court awaited for the Petition and advised them to shorten the modification period, âââ¬Ã
