The Constitutional Court (the Court) held the trial for Election Dispute of Greater Kubu Regency, West Kalimantan Province, Monday (05/01), at the Constitutional Court Building scheduled for Initial Verification. The Case registered under No. 63/PHPU.D-VI/2008 was pleaded by Regent Candidate Pair in Greater Kubu Election, Sujiwo & Raja Sapta Oktohari. Sitting in the position as the Petitionee was the Greater Kubu Election Commission (the Commission).
The Petitioner made a claim against the Announcement made by the Commission No. 38/BA/KPU/KKR/XII/2008 dated 19th of December 2008 about the Announcement of Recapitulation Result of Regent Election in Greater Kubu Regency 2008 and the Announcement of Elected Candidate as Greater Kubu Regent and Vice Regent for 2009 âââ‰â¬Å 2013 period.
According to the Petitioner, the election held by the Petitionee could be considered illegal and legally defected due to the misconducts done by the winning candidate such as, several voters being not on the list still casting votes, intimidation for electing certain candidate, and voter cards giveaway only to people ready to vote for candidate No. 8, Muda Mahendrawan and Andreas Muhrotien, also due to the numerous violations done by Campaign Team for Candidate No. 8.
Using those facts as the background, the Petitioner demanded the Court, at the first place, to announce illegal and hence not legally binding the Decision of the Commission No. 38/BA/KPU/KKR/XII/2008 dated 19th of December 2008 about the Announcement of elected Regent and Vice Regent of Greater Kubu for 2009-2013 period. Secondly, they demanded the Court to announce the Petitioner as the Elected Regent and Vice Regent pair. Lastly, they pleaded the Court to announce the correct and legal recapitulation result was the Petitioner s version which set the Petitioner with 99.371 votes while Candidate Pair No. 8 with 81.305 votes.
Nevertheless, in their Petitum, the Petitioner demanded a compensation fee at the trial expenses on their side. âââ¬ÃÂIn the Constitutional Court, everything is free. There is no such trial fee,âââ¬Ã answered the Head of Justice Panel Board, Akil Mochtar.
Due to that, the Justice Board gave an opportunity to the Petitioner to modify their file. âââ¬ÃÂThe trial is adjourned until tommorrow afternoon (06/01) at 16.00 WIB (GMT+07.00) with Verifying Modified Petition as the agenda, Hearing the Petitioners and Related Parties Exception,âââ¬Ã explained Akil at the closure of the trial.
