The Petitioner claimed against the Petitionee s Decree No. 109 dated December 15, 2008 about the Announcement of Recapitulation Result of the Second Round Regent and Vice Regent Election in Kerinci Regency 2008 won by candidate No. 6, H. Murasman, S.Pd. MM, and Drs. H. MOHD. Rahman.
According to the Petitioner, there had been violations in the recapitulation process done by the Petitionee resulted in false result as follow:
a. Candidate No. 1, Ir. H. Ami Taher and Dianda Putra, S.STP., M.Si gained 80.559 votes;
b. Candidate No. 6, H. Murasman, S.Pd. MM and Drs. H. Mohd. Rahman, MM got 96.768 votes.
Besides that, the Petitioner also claimed that the mistakes in the recapitulation occurred almost in all election regions, Gunung Raya District, Batang Merangin District, Keliling Danau District, Danau Kerinci District, Sitinjau Laut District, Tanah Kampung District, Kumun Debai District, Sungai Penuh District, Pesisir Bukit District, Hamparan Rawang District, Air Hangat Timur District, Depati Tujuh District, Air Hangat District, Siulak District, Gunung Kerinci District, Kayu Aro District, Gunung Tujuh District.
Apart from the violation in the recapitulation process, there were also intimidation and force on the voters to choose a candidate in many areas. âââ¬Ã
âThis caused many of the people are reluctant to come to the Vote Centers because they were afraid,âââ¬Ã explained the Petitioner s Legal Counsel, Zainuddin Paru, S.H. Zainuddin also supported his argument by printed evidence of a short message sent to one of the Petitionerâââ‰â¢s supporter.
Based on those facts, the Petitioner demanded the Court to declare as illegal and announce as legally void the decision of the Petitionee, or in short, to declare as illegal or announce as legally void all recapitulation results in all Districts in Kerinci Regency; State the legal recapitulation result for Kerinci Election 2008 was, the Petitioner, Ir. H. Ami Taher and Dianda Putra, S.STP., MSi, with 103.2992 votes meanwhile H. Murasman, S.Pd. MM and Drs. H. Mohd. Rahman, MM with 96.768 votes.
Responding to the petition, Constitutional Justice Maruarar Siahaan asked, âââ¬Ã
âHave you made a report to the Election Watchers or the Police related to the terror through the short message?âââ¬Ã Zainuddin explained that his party had not reported the incident to the Election Watchers nor the Police. âââ¬Ã
âBut that had been put in the objection written in the transcript of the proceeding,âââ¬Ã he said. Besides that, Zainuddin informed that the person receiving the message until now was still experiencing the fright.
The trial which also read out the Improved Petition would be continued on Tuesday (30/12) scheduled for hearing information from witnesses of each party also the answer from the Petitionee. (Andhini Sayu Fauzia)
