Candidate No. 4, Drs. Parlemen Sinaga, MM and Dr. Budiman Simanjuntak, MKes made a claim against the victory of Candidate No. 2, KRA. Johnny Sitohang Adinegoro and Irwansyah Pasi, SH as the elected Regent and Vice in Dairy Regency, North Sumatra due to the violations in the process of the election. This was revealed in the trial for case No. 60/PHPU.D-VI/2008, Tuesday (23/12), in the Constitutional Court Plenary Court Room.

The Petitioner told the Court about various violations happened, for example, voters with double Citizenship number, voters with double name, voters without Citizenship Number but casting votes, voters who had passed away whose names were used by other people to vote, money politics conducted by Success Team for Candidate No. 2 as many as 18 people, abuse done by Success Team for Candidate No. 2, 821 people rejecting the result of the election also demanding the Commission to annul and to stop the recapitulation process, voters from outside the region, and additional voters data by including incompetent (underage) voters and not originated from the region.

For that, through their Legal Counsel, Roder Nababan, the Petitioner demanded the Court to annul the Decision of Dairy Election Commission No. 37 dated December 13, 2008 which gave win to candidate No. 2 as the Elected Regent and Vice Regent. They also demanded the Court to agree on their recapitulation result with 64.555 votes went to Candidate No. 4, meanwhile Candidate No. 2 had 63.077 votes.

Responding to the claim, South Tapanuli Election Commission through their Legal Counsel, Victor Nadapdap, in the trial held on Wednesday (24/12), explained that the Court was not authorized to examine the Petition because it involved criminal violations occurred in the election which came under general court jurisdiction, except for the Decree issued by the Election Commission which was used as ground for the dispute over election result. Regarding the Citizenship Number, the Petitionee refused to take the blame because it was not in the domain of their authority to make correction. “The numbers is the duty of Citizenship Unit which was lead by the Petitioner, Drs. Parlemen Sinaga,” answered Victor.

For that, in their exception, the Petitionee demanded the Court to state that the claim from the Petitioner as unacceptable. (Wiwik Budi Wasito)
