The Constitutional Court held a trial for South Tapanuli Election, Tuesday (16/12), at the Court s Building with Initial Examination as the agenda. Case No. 55/PHPU.D-VI/2008 was pleaded by candidate pair of South Tapanuli Regent, Drs. H. Rahmad Pardamean Hasibuan and Drs. H. Aminusin M. Harahap, AMK and South Tapanuli Election Commission as the Petitionee.
The Petitioners questioned the Decree of the Petitionee No. 084 dated December 5, 2008 about the Announcement of Recapitulation Result in Second Round Padang Lawas Regency Election 2008 which crowned candidate pair number 7, Basyrah Lubis, SH and H. Ali Sutan Harahap (STO) as the winner with 51.411 legal votes.
According to the Petitioners, such achievement was not mentioned or a part of the South Tapanuli Election Commission Decree No. 084 and not in the Transcript of Proceeding No. 086/KPU-PL/XII/2008 either. That showed the process of the second round election in Padang Lawas 2008 was not going on fair, honest, transparent and it also tended to pick a side.
Besides that, the Petitioners also considered the stages in the election process were against the law such as, Petitioners witness not receiving the C1 Form, the existence of people who was not registered in Temporary Voters List, Permanent Voters List and not receiving an invitation to cast their votes, âââ¬Ã
âthe existence of goods and money given as a compensation to vote for Candidate Pair No. 7 and a number of other violations which affected the recapitulation result,âââ¬Ã said the Petitioners Legal Counsel, Andi M. Asrun.
Based on those fact, the Petitioners demanded the Constitutional Court, first to state illegal and not binding the Decision of the Padang Lawas No. 084 dated December 5/2008 about the announcement of Vote Recapitulation Result in Second Round Padang Lawas Election 2008. Second, to announce the Petitioner as the Elected Candidate in Padang Lawas Election. Third, to announce that the legal recapitulation result was according to the Petitioners Drs. H. Rahmad Pardamean Hasibuan and Drs. H. Aminusin M. Harahap, AMK version as many as 58.630 votes while candidate pair No.7 Basyrah Lubis, SH and H. Ali Sutan Harahap with 37.250 votes.
The trial would be continued on Wednesday (17/12) at 15.00 WIB scheduled to examine improved Petitio and the Legalisation of Evidences. (Andhini Sayu Fauzia)
