Jakarta âââ‰â¬Å Case of misconduct similar to what happened in East Java Election was possible to happen again in General Election 2009 and in Presidential Election. Because of that the Election Commission had to be ready in case the Constitutional Court issued similar decision, re-voting.
"It is highly possible that there will be a re-voting in legislative election, first round presidential election and second round presidential election. If the Election Commission is not ready, it is possible that we don t have a new president in October 2009," said an expert in constitutional law Irman Putra Sidin in a discussion "Impacts of Constitutional Court Decision on East Java Election" taking place in Warung Daun, Cikini Raya St, Central Jakarta, Monday (15/12/2008).
"Then who is to blame? The election organizer, because they are not well prepared," he added.
Irman explained that the Constitutional Court had made a breakthrough in the decision they made. In 2004, the Court s decision regarding Presidential Election were quantitative, meant that the problems were merely counting the vote result. In East Java Election, the Court s decision had gone to a more substantive area. "It is impossible to guard the constitution by using calculator," he said humourously but still in serious tone.
Similar worry was also revealed by the National Coordinator JPPR Jeirry Sumampow. The election organizer from early days had to prepare regulation to anticipate if such case as East Java Election happened in 2009 General Election.
"The Constitutional Court was too far. Our regulation was not set to deal with that so the election organizer was not ready," he said. (sho/iy)
