The trial for dispute over Election result in North Central Timor (NCT) at the Constitutional Court, Wednesday (3/12), was scheduled to hear information from witnesses from the Petitionee (NCT Election Commission). The Petition registered under No. 44/PHPU.D-VI/2008 was filed by a candidate pair participating in the NCT election, Drs. Daniel A. Banunaek, M.A and Drs. Alexander Nakamnu (Damai pair).

Most of the seven witnesses presented by the Petitionee said that the election process had run well. “The election in NCT Regency  had run in a democratic and fair way,” confessed Ampera Sake Selan, Head of General Coordinator for candidate No. 5, Ir. Paulus V.R Mella, Msi and Drs. Benny A. Litelnoni, SH, Msi (Medali pair). Besides that, all witnesses from each candidate pair had received C1-KWK form.

That was also supported by the fact that there were no protests from witnesses of each candidate pair found in the transcript of proceeding in Vote Center and Sub-District level.

However, in South Amanuban District, Friday (24/10), there was a ballot box sawed. “Matheos Te e and Jibrail Nubatonis had sawn the lock of one of the boxes,” explain Jon Sakan, who acted as the subsidiary witness for Medali pair. The destruction of the box, placed inside the Sub-District hall (where the boxes were kept-ed.) was also witnessed by two members of Golkar Party and the Head of South Amanuban District.

Hearing the information from the witness, Head of Justice Panel Board, Arsyad Sanusi, asked Jon, “Did the Watcher Committee notice the incident?” Jon admitted that at that time he had no idea where the Watchers were.

Then, ”why did no members of the Election Watchers know about the incident?” continued Arsyad. Jon replied, “I did not remember where the members of the Election Watchers because I was so focused on the incident.”

Apart from that, according to Jon, the location of the box sawing incident was different from the room for the Election Watchers. “The distance between the room for Sub-district Committe and the room for Election Watchers Team was about 600 meters.” he explained.

The trial for NCT Election case would be continued on Thursday (04/11) to hear information from the Election Watchers Team. (Andhini Sayu Fauzia)
