About 520 Vote Center in North Central Timor (NCT) did not get the vote recapitulation form per Vote Center model C1 KWK. That was delivered by Louisa Nitbani one of the eight witnesses presented by the Petitioner in NCT Election Dispute, Monday (1/12), at the plenary court room of the Constitutional Court. The Petitioner registered under the number No. 44/PHPU.D-VI/2008 was filed by Drs. Daniel A. Banunaek, M.A and Drs. Alexander Nakamnu (Damai pair).

Similar thing was also delivered by Joksan Benu, the Secretary of Damai Team that among the 526 witnesses most of them did not get the C1-KWK form of each Vote Center. “I was only given the DA1-KWK form (recapitulation in District level),” he said. 

Responding to the information from Petitioner s two witnesses, a Member of Panel Board of Justice, Akil Mokhtar, asked, “Were there any objections on each transcript of proceeding signed by both witnesses?”

Joksan who was also the Secretary of the City Council from the Working Group Party answered, “There was no objection on the transcript of the proceeding.” He added that even the Head of Election Committee did not give information regarding the C1-KWK from that was not distributed to the witnesses.

The witness from Damai Success Team, Charles Kause, stated that there was a difference in the number of the people in the Fixed Voter List and in the DA1-KWK model. According to the data in the C1-KWK from, the people in the List which had to be distributed were 257,578 people per location. Meanwhile, after Damai side counted based on DA1-KWK, The Voter List in every location was 262,551 people.

Besides that, Kause also stated that there was a difference in the recapitulation result from the Election Commission and the Petitioner. From the Election Commission side, the final number of the total votes was 218,189. Meanwhile, The Petitioner counted based on DA1-KWK resulted in 218,596 legal votes. “Hence, there was a 407 vote difference,” explained Kause.

The trial would be continued on Wednesday (3/12) scheduled to hear information from the Petitionee s witnesses and evidence examination. (Andhini Sayu Fauzia)
