The file on objection of Iskandar and Kukuh Pudiyarto, Candidate No. 2 for Ogan Komering Ilir Regent, over the recapitulation result of OKI Election was turned down entirely by the Constitutional Court. That was stated in the Verdict Announcement trial for case No. 29/PHPU.D-VI/2008 chaired by the Chief Justice, Moh Mahfud MD, Monday (24/11), at the Constitutional Court Room.
The Petition was based on the claim made by Iskandar and Kukuh Pudiyarto that they should have got 155,233 votes and Ishak Mekki and Engga Dewata pair should have ended up with 86,879 votes. That was different from the announcement of General Election Commission of Ogan Komering Ilir Regency which stated that Iskandar and Kukuh Pudiyarto received 160,395 votes and Ishak Mekki -Engga Dewata attained 190,425 votes. To prove their arguments, Iskandar and Kukuh Pudiyarto filed evidences in form of letters and witnesses.
On contrary, the Court stated that the evidences in form of letters submitted did not show the truth of the claim from Iskandar and Kukuh Pudiyarto. Meanwhile, the witnesses presented by the Petitioners showed that they were not witnesses who saw, heard, or experienced themselves the recapitulation process. âââ¬Ã
âTherefore, their testimonies could not prove that there had been a mistake in the recapitulation done by the Petitionee (OKI Election Commission),âââ¬Ã said Constitution Justice Mukthie Fadjar reading the Legal Consideration of the Decision.
Furthermore, the Court announced that apart from significantly influenced or not the recapitulation result of OKI Election, the letter used as evidences and information from Petitioner s witnesses had shown that there had been many distortions and the corruptive practices in the Election which should have caught the attention of the Election Commission as the organizer of the general election and the Election Watchers Committee to anticipate in the future. âââ¬Ã
