Constitutional Court held a trial on Dispute over Election Result in Luwu Regency, South Sulawesi, Thursday (13/11) scheduled for initial examination. The case No. 33/PHPU.D-VI/2008 was pleaded by Candidate No.1 for Regent and Vice, Basmin Mattayang and Buhari Kahar Muzakkar.

Based on the Decree No. 46/P.KW-K-LW/11/2008, Luwu Regent Election Commission announced candidate No.1 got 57,977 votes. No.2, Andi Muzakkar dan Syukur Bijak reached 83,058 votes. Candidate pair 3, Amir Kaso and Syamsul Sabbea, attained 15,398 votes. Candidate No.4, Rischal A. Pasombo and Sahardi Mulia, got 18.923 votes.

However, the recapitulation made by Regional Election Commission was different from the counting result made by the Petitioners in six Subdistricts/villages in Walenrang District. In that area, the Petitioners lost 1,433 votes. According to the Petitioners, they should have attained 3,323 instead of 1,902 votes as announced by the Petitionees.

Besides that, the Petitioners also added that the Petitionees had done addition or subtraction in the total number of votes in four other Districts as the result, in general, the Petitioners lost 15,480 votes. “Hence, the real number of votes achieved by the Petitioners was as many as 89,391 votes with the calculation and counting 57,977 added by 31,414 votes,” explained the Petitioners Legal Counsel, Nasirudin Pasigai.

For that, in the Petitum, the Petitioners demanded the Constitutional Court to grant the demand by announcing the Petitioners recapitulation with 89,391 votes for their victory as the correct one and annulling Election Commission Decree also ordering the Election Commission to announce the Petitioners as Regent and Vice Regent of Luwu for 2009-2014 periods.

In this case, Justice Panel Board advised the Legal Counsel of each party to maximally complete their evidences, especially in the number of vote area. “Please notice that in order to make the process faster and smoother and the Court could reach its decision soon,” said the Head of Justice Panel Board, Achmad Sodiki.
