Apart from the controversy of June 1 as the birth of Pancasila, Chief Justice of the Constitutional Court (MK), Jimly Asshiddiqie, asked all Indonesian people to commemorate it by socializing Pancasila and the 1945 Constitution as the uniting power for the diverged people, in form of religions, ethnics, races, economic and education levels, also diversity in languages.
That was delivered in the press conference held in the Chief Justiceâââ‰â¢s delegation room, on Monday (2/6).
Substantively, the first norm, Believe in the Almighty God, emphasized that Indonesian people was a nation that admitted the principle of One Almighty God. âââ¬Ã
âWe have the same God, The Almighty God. It is only that we express Him with many names, through many ties, shapes and forms, and religious colors that each and every one of us believes,âââ¬Ã explain Jimly.
For that, Jimly reminded Indonesian people not to forget the diversity of their nation. The founding leaders, continued Jimly, had agreed that the formulation of Pancasila was non-negotiable as a nation-binding power.
In the previous concept of the government, that is Tri-harmonies among religion believers: harmony among believers within the same religion, harmony among believers of different religions, and the harmony between the religion believers and the government, according to Jimly, they could be made more dynamically. When many citizens expressed freedom excessively, then a new realization on the importance of tolerance and cooperation should be developed. âââ¬Ã
âThe cooperation also applies for the harmony between religion believers and the State, not only the government,âââ¬Ã he explained.
Related to the violent tragedy conducted by Islam Defender Front (FPI) towards the Nation Alliance for Freedom of Religion and Belief (AKK-BB) on Sunday (1/6), Jimly expected that the incident would never happen again. âââ¬Ã
âThis is against Pancasila. I hope the security forces can act strictly to show that this country protects its citizens at best according to our aim of being in a state,âââ¬Ã explained Jimly.
Meanwhile, to secure the freedom of uniting, if there was an initiative to dissolve an organization (politic, religion, or people), Jimly advised it should be taken a legal effort. âââ¬Ã
âThe Government should not make a decision. Related to the conflict, the final decision lies in the judges. So the government can take a legal effort through the court,âââ¬Ã he said.
For the dissolution of a political party, the legal effort was through the Constitutional Court. Meanwhile for a non-political organization, it should be appealed through the general court.
Related to the plan to dissolve Ahmadiyah, Jimly did not agree if the State interfered because it was considered as internal problem of the Moslems. Jimly commented that, apart from the legal effort, it would be better for Islam figures to discuss on the matter with tolerance spirit. âââ¬Ã
âThis is aimed to create an internal dialogue and cooperation of Moslems. That is more important,âââ¬Ã emphasized Jimly.
Before closing his statement, Jimly advised all Islamic groups to create a peaceful condition, make a self-evaluation, and not to be easily provoked, and vice versa, they should spread optimism to all citizens that unity still exists, within the Union Country of Republic of Indonesia (NKRI).
Up to this moment, said Jimly, there were four pillars of nationality that Indonesia followed; they were the spirit of Bhinneka Tunggal Ika (Unity in Diversity), Union Country of Republic of Indonesia, the 1945 Constitution, and Pancasila. âââ¬Ã
