The Constitutional Court issued the Stipulation that the case No. 5/PUU-VI/2008 on the trial of Article 77 letter a, Article 83 paragraph (1) and paragraph (2) of Act No. 8 Year 1981 on Penal Code (KUHAP) was withdrawn. The Stipulation No. 40/TAP.MK/2008 was read out by the Chief Justice of the Constitutional Court, Jimly Asshiddiqie, Thursday (13/3), at the Plenary Court Room of the Constitutional Court.
This was related to the letter that the Petitioner Soeparno delivered by faximile to the Registrar of the Constitutionalo Court a moment before the trial that he failed to attend on March 3, 2008. The Head of Constitution Justice Panel, Hakim Konstitusi H.A.S. Natabaya, at the trial which was supposed to examined the improvement of petition announced that the letter did not have a signature therefore it needed to be confirmed. The Petitioner then submitted a letter dated February 29, 2008 and received by the Registrar of the Constitutional Court on March 6, 2008 with the case withdrawal as the mainpoint.
At the trial opened to public today, after being asked for a confirmation directly by the Justice Board, the Chief Justice then read ourt the Stipulation stating that the Board of Justices granted the withdrawal and stating that the Petitiober could not re-filed a trial on Article 77 letter a, Article 83 paragraph (1) and paragraph (2).
