The amendment of 1945 Constitution affects our state regulation a lot. “There are some institutions which still exist but with different authorities from the past. There are some institutions that do not exist anymore. And there are some institutions that newly set up too”, said Constitutional Justice Prof.H.A.S. Natabaya, S.H. LLM in front of the students of STKIP Subang in their visit to  Constitutional Court, Thursday (21/02) at Constitutional Court Building, Jakarta.

The effects of the amendment, said Constitutional Justice Natabaya among others were on the People’s Deliberation Board (MPR), that was even though institutionally MPR still existed the structure also the authorities of which had changed so much compared to the condition before the amendment of the 1945 Constitution. In the pre-amended Constitution, MPR was the highest State Institution as the executor of people’s sovereignty, meanwhile after the amendment MPR was only one of the High State Body; whereas people sovereignty previously executed by the MPR, now should be executed based on the Constitution.

Meanwhile the institution used to be in the Constitution but not now was the Supreme Advisory Council. “An example of an institution didn’t use to be in the Constitution but now there is in the Constitution is the Constitution Court”, he added.
When answering a question from a student regarding the role of the Constitutional Court in the Regional Election and the General Election, Natabaya said that there were chambers to settle different problems. “If the problem is about the result, then it could be settled in the Constitutional Court. However, if it is other problems such as embezzlement or other criminal cases, then they could be settled in Common Court,” he explained.

The visit of the students from STKIP Subang, who were mostly school teachers, aimed to improve teachers understanding about the Constitutional Court. It is hoped that after they returned to their schools, they could explain what they got to the students. (Yogi Djatnika)
