The Constitutional Court held a hearing for case No. 22/PUU-V/2007 on the judicial review of Law No. 25 Year 2007 concerning Capital Investment (the Investment Law) against the 1945 Constitution on Thursday (4/10), at the session room of the panel of Constitutional Court with the agenda of Examination of The Revised Petition.
In the statement of claims (petitum) of their original petition, the Petitioners, namely Daipin, cs., with their Attorney-In-Fact, Patra M. Zen, S.H., LLM. Cs from the Indonesian Legal Aid Institute Foundation (YLBHI), requested the Panel of Constitutional Court Justice to declare the substance of Article 4 Paragraph (2) Sub-Paragraph a, Article 8 Paragraphs (1), (2), (3), (4) and (5), Article 12 Paragraphs (1), (2), (3), (4), and (5), Article 21, Article 22 Paragraphs (1) and (3) contradictory to the 1945 Constitution, and at the same time the Petitioners also request the Panel of Constitutional Court Justice to declare the Investment Law contradictory to the 1945 Constitution.
However, in the statement of claims (petitum) of their revised petition, the Petitioners request the Panel of Constitutional Court Justices to declare the substance of Article 1 Paragraph (1), Article 4 Paragraph (2) Sub-Paragraph a, Article 8 Paragraph (1) and Paragraph (3), Article 12 Paragraph (1) and Paragraph (3), Article 21, Article 22 Paragraphs (1) and (2) of the Investment Law contradictory to the 1945 Constitution.
In relation to the status of the Petitioners who previously acted as the management or administrators of certain organizations, in the revised petition they have changed their status as individuals with the professions of fishermen, traditional merchants, laborers and farmers.
With respect to the revised petition, the Panel of the Constitutional Court Justices declared to accept the Petitionersââ¬â¢ petition as well as authorized the list of evidence enclosed by the Petitioners. ââ¬ÅFor the sake of an efficient proceedings, we will incorporate the examination of the previous case (Case No. 21/PUU-V/2007 ââ¬â ed) requesting the Constitutional Court to review the same provisions in the next plenary hearingââ¬Â said the Chairman of Panel of Justices Dr. H.
