The four amendments to the 1945 Constitution, namely the First Amendment (1999), the Second Amendment (2000), the Third Amendment (2001), and the Fourth Amendment (2002), have brought about significant changes in Indonesian state administration system, including legislative, executive, and judicial institutions and authorities.
According to the Constitutional Justice Prof. H. Abdul Mukthie Fadjar, S.H., MS., the amendments to the 1945 Constitution have also affected political parties particularly with regard to political parties dissolution, by providing that one of the constitutional authorities of the Constitutional Court is to decide the dissolution of political parties, aside from to hold the constitutional judicial review of laws, to decide the dispute on the constitutional authorities of state institutions, to decide the dispute of the general election result, and to have obligation in deciding the Peopleâs Legislative Assemblyâs opinion on alleged violations committed by the President and/or the Vice President.
The abovementioned matter was conveyed in the colloquium of âThe Constitutional Court in the Indonesian State Administration Systemâ which was held by the Secretariat General and the Registrarâs Office of the Constitutional Court with the Widyagana University Malang on Saturday (16/6) in Malang City.
In relation to the development of regulations on the dissolution of political parties in Indonesia, Mukhtie stated that the development of such regulations has been in line with the development of democracy. âIf Indonesia becomes more democratic, the principle of due process of law in the dissolution of political parties will be more accommodated,â he said.
Mukthie also conveyed his opinion that the constitutional authority of the Constitutional Court to decide the dissolution of political parties is a consequence of the function of the Constitutional Court as the guardian of the constitution and the vision for realizing a democratic, modern, and dignified Constitutional State of Indonesia.
