Chief Justice of the Court: APHTN-HAN Intellectuals Must Be Able to Find Alternatives for Scientific Development

BALIKPAPAN (MKRI) - Chief Justice of the Court (MK), Suhartoyo, officially opened the National Conference of the Association of Teachers of Constitutional Law and State Administrative Law (KNAPHTN-HAN) III on Friday (12/6/2024) in Balikpapan. The even entitled "New Government: Opportunities and Challenges from the Perspective of Constitutional Law and State Administrative Law" is scheduled to take place on Friday to Monday, 6th to 9th December 2024.

Chief Justice Suhartoyo, in his remarks said that APHTN-HAN teachers, academics or intellectuals have a big role and responsibility for developing the benefit of science in order to find good values, achieve a degree of civility, a science-based dialectic, and provide alternative solutions to contemporary problems. Therefore, the integrity of scientific attitudes is the main intellectual key to confirming science as a truth production regime, science free of prejudice or interests. So intellectuals are required to find alternatives for scientific development of HTN-HAN, both methodological, ontological, axiological and epistemological aspects. In this way, the validity of the science developed can be accounted for.

"The development of theoretical law related to the existence and application of law with all scientific activities to obtain intellectual mastery of law or the meaning of law systematically, logically and rationally. Its development is divided into three levels of abstraction, namely legal science, legal theory, and legal philosophy. "Among these three things are the responsibilities of intellectuals," explained Chief Justice Suhartoyo in an event attended by Constitutional Justice M. Guntur Hamzah, Chairman of the Indonesian KPU, M. Afifuddin, and Secretary General of the Court, Heru Setiawan.

Dynamics of Constitutional Law (HTN) Development

Constitutional Justice M. Guntur Hamzah in his Justice Lecture presented material with the theme "The Constitution and the Dynamics of Constitutional Law and State Administrative Law" in front of the national conference participants. Justice Guntur said that the development of state administration in Indonesia was very dynamic. This can be seen from the well-organized general elections and regional head elections which are still in their stages. Apart from that, it can also be seen from the terminology that power is not centralized in one power holder, namely that there are executive, legislative and judicial powers as well as independent powers, such as the BPK, KPK, BI, KPU and others.

"However, in its development it is not only limited to what exists, this dynamic is always rolling which means that the center of power is no longer at one epicenter, but centripetally spread everywhere, such as the existence of bureaucracy such as secretaries general, deputies and the like who run the elements of the organization. Therefore, the bureaucracy can also be called the holder of power. Apart from that, there is also the mass media which holds power and greatly influences the state's strategic policies. How the media endorses the country's goals by disseminating actual, sharp and trustworthy information. "There are also non-governmental organizations that hold power because in their critical and constructive hands they really influence policy makers in making every decision," explained Justice Guntur.

This event opened the Call For Paper with six national panels and one international law panel, including three panels on Constitutional Law, three panels on State Administrative Law, and one panel on International Law. Manuscript acceptance began on 9th October to 12nd November 2024. Meanwhile, the announcement of selected manuscripts will be on 16th November 2024.

For your information, currently APHTN-HAN has 1500 members spread across 37 provinces with regional management. Every year, APHTN-HAN builds relationships with teachers in developing human resource creativity as well as teaching and developing constitutional law and state administrative law in the APHTN-HAN National Conference forum.
