SEMARANG, MKRI Public Relations - Constitutional Justice Arief Hidayat delivered a keynote speech at the series of National Seminar in the  Diponegoro Law Fair 2024. The seminar took place at the Diponegoro University (Undip) Auditorium on Sunday (10/27/2024).

In his speech entitled "Dissenting Opinion as a Form of Functional Independence of Justices," Justice Arief highlighted the importance of the role of justices in maintaining freedom and functional integrity in making legal decisions. He emphasized that a Justice of Constitutional Court (MK) must deeply understand the values of Pancasila and state principles, considering that the Court plays a strategic role in determining the direction of state policy.

Justice Arief also underlined the importance of an independent judiciary, as well as maintaining consistent functional independence of justices and budget independence as a reflection of a constitutional democratic state. According to him, the Court is an institution that exercises judicial power independently to uphold law and justice, where any form of intervention in judicial affairs is not permitted, except in matters which are regulated in the 1945 Constitution of the Republic of Indonesia.

Justice Arief added that Indonesia now adheres to a mixed legal system between civil law and common law, especially with the presence of the Constitutional Court which allows differences of opinion or dissenting opinions in decisions as something normal. He stated that dissenting opinions are important to provide different points of view that can be used as material for public study and are a form of judge's accountability to God Almighty.

At the end of his speech, Justice Arief invited the participants to implement the law as well as possible and reminded intellectuals to be a compass that directs positive change without being trapped by power. He also reminded students to maintain the right rule of law, especially in supervising the regional head elections so that people can choose the right leaders for the good of the region and the nation.
