Judges of the High People's Court of China's Heilongjiang Province Visit the Court

JAKARTA, MKRI HUMAS - A number of high-ranking judges of the High People's Court of Heilongjiang Province, China, visited the Constitutional Court of the Republic of Indonesia (MKRI) on Tuesday (22/10/2024). The Chinese delegation consisted of the Vice President of the Higher People's Court of Heilongjiang Province, Ma Guo; the President of the Shuangyashan Intermediate People's Court in Heilongjiang Province, Liu Xuefeng; the Head of the First Civil Division at the Higher People's Court of Heilongjiang Province, Wang Yao; and the President of the Huachuan County People's Court in Jiamusi, Heilongjiang Province, Wu Haipeng.

They wanted to exchange ideas and learn about cases handled by the Constitutional Court related to the protection of women and children. "This time, we came with the aim of exchanging ideas in the process of family cases, especially marriage cases in court proceedings, especially the protection of women and children," Judge Ma Guo said.

In this bilateral meeting, the Constitutional Court was represented by the Head of the Public Relations and Protocol Bureau, Pan Mohamad Faiz; the Head of the AACC Permanent Secretariat and Foreign Affairs Division, Immanuel Bungkulan Binsar Hutasoit; the Head of the AACC Permanent Secretariat Subdivision, R.A Indah Apriyanti; the Head of the Foreign Affairs Subdivision, Hasri Puspita Ainun; and their staff. Faiz explained the brief history of the establishment of the Constitutional Court and the differences between the Supreme Court of the Republic of Indonesia and the Constitutional Court.

“There are two higher judicial institutions, namely the Supreme Court of the Republic of Indonesia and the Constitutional Court of the Republic of Indonesia, which are equal in power,” Faiz explained.

Faiz added that the Supreme Court is tasked with judging at the cassation level with the authority to examine laws and regulations below the law. The Supreme Court oversees judicial bodies in the criminal/civil, administrative, military, and religious domains. Meanwhile, the Constitutional Court is tasked with maintaining and upholding the Constitution with the authority to examine laws against the 1945 Constitution. The Constitutional Court does not have a branch of judicial power, and only one is located in the capital city of the country.

Faiz also mentioned a number of Constitutional Court decisions that safeguard and protect the constitutional rights of citizens, especially women and children. Among other things, the Constitutional Court has given civil rights to children born out of wedlock, including the rights provided by biological fathers. Previously, the provisions of Article 43 paragraph (1) of Law Number 1 of 1974 concerning Marriage regulated that children born outside a legal marriage only had a civil relationship with their mother and their mother's family because the marriage was not recorded in the state administration system.

After the discussion, the judges of the Heilongjiang Provincial High People's Court had the opportunity to meet with Chief Justice Suhartoyo. The chief justice and the judges discussed how each country provides protection to women and children, including the granting of inheritance rights.

Chief Justice Suhartoyo said that, hopefully, in China, a Constitutional Court will be established. “Hopefully, in China, it can be established on its own,” he said.

He also hoped to cooperate in the future to establish good bilateral relations. Chief Justice Suhartoyo also hoped to visit the High People's Court of Heilongjiang Province.

Previously, the high judges of the Heilongjiang Provincial High People's Court had a look around the Court’s office, including the opportunity to attend court proceedings. (*)
