JAKARTA, Public Relations of the Court - In order to enrich knowledge in the field of constitutional law, especially related to family law issues, a number of Family Law Students from IAIN Syekh Nurjati Cirebon visited the Constitutional Court (MK) on Monday (10/7/2024). The delegation was warmly welcomed by Expert Assistant to Constitutional Justice, Suryo Gilang Romadlon, in the delegation room, building I of the Court.
In his presentation, Suryo Gilang Romadlon, who is familiarly called Gilang, said that the Court in exercising its authority is accommodated by the constitution in Article 24C. "In carrying out its authority, the Court also gave interpretation several times. The Court does not just carry out review, but in its decision there are several interpretations or meanings.
Gilang emphasized that the Court acts as 'The Final Interpreter of the Constitution'. Although not all petitions are granted, Court decisions often contain in-depth constitutional interpretations. As an illustration, in its latest decision, the Court has delivered a careful analysis of the meaning of the phrase 'whoever' in the Criminal Code, which has significant implications for cases of child custody struggles.
"In the final decision there are also values that can be highlighted by all of you, regarding the Court's standing towards the phrase 'Whoever' in the Criminal Code which will be experienced by parents who are experiencing a struggle for child custody," he explained.
Gilang added that in 2010 the Court granted a petition regarding the civil rights of illegitimate children. The Petitioner argued that children born out of wedlock often experience discrimination and lose their civil rights. Through its decision, the Court emphasized that all children, including illegitimate children, have equal rights before the law and are entitled to state protection.
"The state has the position of administrator, so the state is actually responsible for keeping records. In the context of the case at the Court, the civil rights of these children should be granted by the state and recorded. So, the Court has stepped in to give meaning as long as it can be proven that the biological father is. So that this child has the same rights as other children, there is no discrimination. "The Court is quite concerned about considering about these children," explained Gilang.
At the end of his presentation, Gilang hoped that the presentation that had been delivereed would be useful for the students. According to him, discussing family law has become more interesting. (*)
