Continuing Digital Library Development, MK Holds FGD on Digital Literature Law and Ethics

BEKASI, MKRI Public Relations – In the context of developing digital libraries in the legal sector, the Court held a Focus Group Discussion "Legal and Ethical Aspects in the Development of the Digital Court Library (DCL)" on Tuesday (9/24/2024). This event was officially opened by Secretary General of the Court, Heru Setiawan, at the Court’s Archives Building, Bekasi, West Java. In his remarks, Heru stated that in order to strengthen the Court's decisions made by Constitutional Justices, the Court needs increasingly complex references.

"However, we are still hampered by the phases of digitizing printed or written literature and the management process on the legal and ethical aspects of a digital library. "So today, we need to discuss technology and legal and ethical aspects in responding to this challenge to create fair digital literacy as is the aim of the existence of law for justice seekers," explained Heru.

Synergy of Law Librarians

In the event’s report,  Head of the Center for Research and Case Review, and Library Management, Pan Mohamad Faiz mentioned that the event was a follow-up to the previous activity related to the Digital Court Library (DCL), so today's activity will discuss further the legal and ethical aspects related to the digitization of literature. Apart from that, this agenda was implemented to expand and strengthen communication with libraries and the network of legal librarians. Then this event was attended by 38 participants consisting of internal and external MK.

"Unlike other discussion events, on this occasion the FGD participants are expected to play an active role so that they can ask questions, thoughts, ideas and matters related to the legal context of digital library. "With similar views as a result of this discussion, this FGD can become a forum for building synergy and a repository for legal librarians in the future," explained Faiz.

Digital Literacy Signs

Legal Analyst at the Ministry of Law and Human Rights, Achmad Iqbal Taufiq, said that regarding legal regulations in digitizing library collections, there are basic things that shall be understood, including technological developments and the copyright industry. He said, basically Copyright protection automatically appears when the creation is realized; protected works shall be tangible, have a form and be original; and is universal, meaning that the protection of works from creators from one country also applies to other countries. Talking about literary works includes books, journals, periodicals publication, magazines and newspapers as well as other forms of papers, all of which are protected as copyright.

"In fact, digitalization is the key to facing challenges and utilizing  opportunities in the digital era. "By utilizing digital technology, we can increase access to information, efficiency, innovation and collaboration, as well as support sustainability and data protection," explained Iqbal.

Iqbal emphasized that in implementing digitization it is necessary for each party to pay attention to the guidelines in the Copyright Law (UUHC) which include digitizing library collections for non-commercial purposes; will only be used for educational or research purposes; only make 1 (one) copy of the work or part of the work; carried out for maintenance, replacement of necessary copies, or replacement of copies in the event that copies are lost, damaged, or destroyed from the permanent collection in the library.

Books and Technology

Meanwhile, Hikmat Kurnia in his presentation entitled "Digitalization of Library Collections from a Publisher's Point of View" said that talking about the world of books cannot be separated from an understanding of the world of information, that as long as the information presented in the form of books is needed by the reading public, then its presence will always be relevant to the season, whatever form it takes, because basically actual books and books in form of paper, or digital, make no difference.

Discussing digitalization of literacy related to copyright, Hikmat said that there is an institution that cares about copyright, namely the Copyright Care Association (PPKC). This non-profit organization, continued Hikmat, aims to accommodate, facilitate, mediate disputes between work owners, help forward reports of copyright violations, prevent hijacking, tackle hijacking, and other things related to the copyright of its members.

In carrying out its activities, PPKC continues to coordinate with the Ministry of Law and Human Rights, law enforcement authority, market places, applicators, to clean up hijacked digital books circulating illegally in cyberspace. “In essence, respect for copyright brings glory, hijacking causes destruction. "books for being read and not for being hijacked," said Hikmat, who is the Chair of the Indonesian Publishers Association (IKAPI) DKI Jakarta.

Developing a Digital Library

In addition, Ofy Sofiana discussed "Development of Digital Libraries in Specific Libraries" stating that the library at the Court was classified as a Specific Library. Because this library is intended on a limited basis for users within government institutions, community institutions, educational institutions, religious institutions, places of worship, or other organizations. This is based on Law Number 43 of 2007 and Government Regulation  Number 55 of 2021 on Implementing Regulations of Law Number 13 of 2018 on Handover Storage of Printed and Recorded Creations (SSKKKR).

"In developing a digital library, there are several factors that must be considered, including needs analysis and determining goals based on the vision and mission of the parent institution; a feasibility study whose assessment includes whether it is technically feasible and whether it is socially acceptable; "selection of software is useful when developing a database for digital library purposes," said the Main Librarian of the National Library.

Digital Services

Meanwhile, Sony Pawoko explained about "Development of Digital Collections at the University of Indonesia Library". That managing sources of information or knowledge or reading in the digital era is the same as managing treasure, because before information is digitized, its actual form can be categorized into several categories, namely primary, secondary and tertiary sources. In managing digital collections at the University of Indonesia Library, the main forms are thesis, dissertations and final assignments. "The development of technology has led us to reading rooms that make it easier for users to get reading materials cheaply or for free. "So in managing the digitization of this library, how do we then collect it, process it, reserve it and disseminate it," explained the University of Indonesia librarian.

For your information, this event was held for two days from Tuesday to Wednesday (24 – 25/9/2024) with several discussion sessions. In Session I, FGD participants will listen to a presentation on Legislative Regulations in digitizing library collections which will be delivered by Achmad Iqbal Taufiq who is a Legal Analyst at the Indonesian Ministry of Law and Human Rights; and a discussion about the Digitalization of Library Collections from a Publisher's Point of View which will be delivered by Hikmat Kurnia as Chair of the Indonesian Publishers Association (IKAPI) DKI Jakarta. Then in Session II, FGD participants will listen to material about Supervision and Development of Digital Libraries in Specific Libraries delivered by Ofy Sofiana, M.Hum (Senior Librarian of the National Library); and material entitled "Development of Digital Collections in the University of Indonesia Library" which will be delivered by Sony Pawoko (University of Indonesia Librarian).

The following day in Session III, FGD participants will gain knowledge about "Digitalization of Library Collections from the perspective of Intellectual Property Rights and Telematics" presented by Edmon Makarim (Lecturer at the Faculty of Law, University of Indonesia); and material related to "Intellectual Property Rights Perspective on the Digitalization of Library Literature" by Yudho Taruno M (Member of the Education Sector of the Association of Teachers of Intellectual Property Rights (APHKI). Finally, in Session IV, the preparation of recommendations regarding legal and ethical aspects in the development of digital libraries will be carried out; and Discussion of Collaboration between the Constitutional Court Library and the Law Library (*)
