JAKARTA, Public Relations of the MKRI – The Court (MK) welcoming a visit from Global Mandiri High School students, on Tuesday (8/27/2024). The visit was welcomed directly by Expert Assistant to Constitutional Justice, Winda Wijayanti, in the Hall of the Court Building I.
Winda began her presentation about the background to the establishment of the Court, the authority and obligations of the Court. The Court was founded when reformation occurred in Indonesia when the 1945 Constitution was amended in four stages. This amendment led to the abolition of the highest state institution in Indonesia. Winda explained that the Court was a new judicial institution which was established after amendments to the Constitution. One of its tasks is to resolve disputes between state institutions. Because after the amendments, all state institutions are equal in nature, namely becoming high state institutions.
In early history, the idea of forming a Constitutional Court was initiated by Muhammad Yamin after Indonesian independence, namely the need for a judicial institution whose task was to review the constitutionality of a law. This can be executed by the Balai Agung (Supreme Court). "Soepomo rejected this idea because at that time there were not many law graduates in Indonesia," she explained.
Then, Winda also explained that the Court had the authority to review laws against the Constitution. "Resolving disputes over the authority of state institutions whose authority is granted by the 1945 Constitution, deciding on the dissolution of political parties, and deciding disputes regarding the results of general elections," said Winda. The Court has an obligation according to Article 24C paragraph (2) of the 1945 Constitution, namely to provide a decision based on the opinion of the House of Representatives regarding alleged violations by the President and/or Vice President according to the Constitution (Impeachment to the President).
Moreover, Winda also delivered the procedures for filing a petition to the Court, either directly by coming to the Court or by submitting online via the official Court website which can be accessed anytime and anywhere by the petitioner. Then she also explained the stages of the hearing at the Court, starting from the preliminary hearing, the petition revision hearing, the examination hearing, up to the decision hearing.
Winda said that the Court's decision was final and binding. "Because of the final and binding nature, it cannot be submitted again because it is final. "It can be submitted again by the same petitioner but with different reasons," she said. According to her, decisions that have been declared granted by the Court must be promulgated in the State Gazette. This aims to ensure that all Indonesian citizens and all state institutions know and accept the Court's decision. The meeting continued by questions and answers which were responded enthusiastically. Then, students are invited to tour on 5th and 6th floor exploring the Constitutional History Center (Puskon MK).
