Hearing Meeting with Commission III of the DPR RI: MK Maintains WTP Opinion for 18 Consecutive Times

JAKARTA (MKRI) – During a Hearing Meeting (RDP) with Commission III of the House of Representatives (DPR RI), Secretary General of the Constitutional Court (MK) Heru Setiawan presented the 2023 MK Financial Report as well as the audit results from the Audit Board of Indonesia (BPK) for the years 2023 and 2024. The meeting took place on Wednesday afternoon (August 21, 2024) in the Commission III meeting room at the DPR.

Heru revealed that as of December 2023, MK’s budget realization stood at 99.95% or Rp406 billion out of a budget allocation of Rp407 billion. The 2023 MK budget was utilized for several areas, including handling constitutional cases, enhancing the understanding of citizens' constitutional rights, disseminating information about MK cases and decisions, management support programs, international cooperation activities, planning, evaluation and financial management, housekeeping, security, procurement, archiving, and dispatch services, internal oversight, human resource management, organizational structuring, and bureaucratic reform. It also covered expenses for personnel, goods, and capital expenditures.

On this occasion, Heru presented the financial report for MKRI in 2023 and the audit results by BPK for 2023 and 2024. “MK has once again received an Unqualified Opinion (WTP) from BPK, marking the 18th consecutive time since 2005 to 2023. The budget realization for MK in 2023, which ended on December 31, 2023, reached 99.33% or approximately Rp44 billion out of the total budget of Rp47 billion,” Heru explained.

Heru also disclosed that the 2023 MK expenditure realization reached 99.33%, or about Rp44 billion, out of a total budget of Rp47 billion. This budget was allocated for two main programs: the management support program and the case handling program. Specifically, Rp161 billion was allocated for case handling with a realization rate of 99.29%, while Rp245 billion was used for the management support program with a realization rate of 99.36%.

Regarding the follow-up to the BPK audit findings through the first semester of 2024, Heru reported that since 2005 to 2023, MK has resolved 99.4% of all recommendations given by BPK, with only 0.6% still in the process of being completed. Of the total follow-ups, 355 recommendations have been implemented according to regulations, while two recommendations are still in progress. BPK also audited MK's 2023 financial report and issued an Unqualified Opinion (WTP) without any material findings or recommendations for returning funds to the state treasury. All BPK recommendations were administrative and required only system improvements.

Following the presentation session, Muhammad Nasir Djamil, a member of Commission III from the PKS faction, raised a question regarding the formation of the State Loss Settlement Assembly. Nasir questioned whether this assembly, established at BPK's request, is similar to the State Loss Consideration Assembly at the provincial, district, and city levels, and whether its establishment is truly necessary.

In response, Heru explained the procedures related to the theft of video conference (vicon) equipment that had occurred in several locations, including Papua. He stated that when vicon equipment is stolen, MK is obliged to report it to BPK and calculate the loss based on the purchase value and current value. The person responsible for managing the equipment in the region remains accountable for the loss.
