Petition Rejected, Nasdem Fails to Secure 2nd and 3rd Seats for the House of Representatives in the Papua Pegunungan

JAKARTA (MKRI) — The Constitutional Court rejects the petition Case No. 231-01-05-37/PHPU.DPR-DPRD-XXII/2024 filed by the National Democratic Party (Nasdem) over the Election Results Dispute (PHPU) for the House of Representatives in the Papua Highlands electoral district, the Nduga Regency Legislative Council electoral district 1, Nduga Regency Legislative Council electoral district 3, and the Yahukimo Regency Legislative Council electoral district 4. According to the Court, the claims made by the Petitioner are legally unfounded.


"In the main petition, the petition of the Petitioner is rejected in its entirety," stated Chief Justice Suhartoyo during the ruling hearing, accompanied by eight other constitutional justices on Monday, June 10, 2024.

Constitutional Justice M Guntur Hamzah explained that the Court cannot verify the vote acquisition claimed by the Petitioner because there are no Form C. Results from the polling stations presented to the Court. Therefore, according to the Court, the vote acquisition as found in the Form D. Results for the Regency/City Legislative Councils, which matches the data from the Form D. Results at the Subdistrict level of the Regency/City Legislative Councils in each district contested by the Petitioner, is legitimate and has undergone a tiered recapitulation and supervision process from the district to the regency level.


Although there were written objections from the Petitioner's witnesses during the plenary recapitulation meeting at the regency level, it turned out that there were no recommendations from the Yahukimo Regency Elections Supervisory Body (Bawaslu) as affirmed by Bawaslu Yahukimo during the trial. Therefore, the Petitioner's claim that there was a shift in vote acquisition by 6,210 votes because the plenary recapitulation meeting at the regency level did not follow the agreements made in several districts of Yahukimo Regency is legally unfounded.

In its petition, the Petitioner stated that the discrepancy in the vote count for the Nasdem Party between the Petitioner's version and the Respondent's (General Elections Commission, KPU) reached 80,975 votes. According to the Petitioner, this number of votes shifted to other parties, including PSI and PAN. Due to the reduction in its vote acquisition and the increase in votes for other parties, Nasdem lost one seat in the House of Representatives for the Papua III electoral district, thus failing to secure its second seat. However, the Petitioner claims that if the votes for the Nasdem Party were as requested by the Petitioner, in accordance with the customary agreements of the Papua Highlands, amounting to 551,293 votes, the Nasdem Party would have obtained a third seat.

In its petition, the Petitioner requests that the Court annul KPU Decision No. 360 of 2024 concerning the Official Results of the General Elections for Members of the House of Representatives, the Regional Representatives Council, Provincial Legislative Councils, and Regency/City Legislative Councils nationally in the 2024 Elections, which was announced nationally on Wednesday, March 20, 2024, at 22:19 WIB, insofar as the vote acquisition for the House of Representatives in the Papua Highlands, Nduga Regency Legislative Council electoral districts 1 and 3, and Yahukimo Regency Legislative Council electoral district 4, and to establish the correct vote acquisition according to the Petitioner for filling memberships in the House of Representatives for the Papua Highlands as follows: Nasdem Party's vote acquisition of 187,780 votes and securing the third seat; restoring the correct vote acquisition for Nduga Regency Legislative Council electoral district 1 to be Nasdem Party's 9,044 votes; restoring the correct vote acquisition for Nduga Regency Legislative Council electoral district 3 to be Nasdem Party's 2,198 votes; establishing the correct vote acquisition according to the Petitioner for filling memberships in the House of Representatives for the Papua Highlands as follows: Nasdem Party's 5,069 votes and securing the third seat.
