Court Dismisses PDIP's Petition Alleging Vote Transfer to PKB in West Sumatera 4

JAKARTA, MKRI – The Constitutional Court (MK) delivered during a hearing No. 116-01-03-03/PHPU.DPR-DPRD-XXII/2024  for the 2024 DPRD (Regional Legislative Council) election results dispute. The case was petitioned by PDI-P (Indonesian Democratic Party of Struggle) for the electoral district of West Sumatra 4. According to the Court, the argument that there was a shift in votes from PDIP to PKB is unreasonable according to the law.

“In the main petition, reject the Petitioner's petition in its entirety,” said Chief Justice Suhartoyo alongside the other eight constitutional justices, on Monday, June 10, 2024.

Constitutional Justice Daniel Yusmic P. Foekh, that the Court compared the evidence related to the vote acquisition at all questioned TPS. The Court found consistency in the number of votes in C. Results and D. Results in accordance with the evidence submitted by the KPU, Relevant Parties, and Bawaslu. According to the Court, the differences found are the result of corrections of summation or writing errors.

The Petitioner argued that the difference in votes between C. Copies and D. Results resulted in a reduction in PDIP votes in a number of TPS out of 45 TPS in question, including the addition of votes for the Relevant Party PKB. The Court believes that the difference in the number of votes is due to the correction of errors that occur in accordance with applicable laws and regulations.

“The Court is of the opinion that the Petitioner's has no basis in law,” said Constitutional Justice Daniel Yusmic P. Foekh.

In its petition,  PDIP explained that during the tiered recapitulation process, the assigned witnesses found irregularities and discrepancies between C. TPS results and D. Results at the District, Regency, Provincial, and National Election Committee levels. Through the assigned witnesses, the Petitioner has filed D. objections to the recapitulation of the vote count at the West Pasaman Regency/city level.

The Petitioner compares the difference in the vote acquisition of PDIP and the PKB (National Awakening Party) based on C. Copy Results and D. Results in West Sumatra electoral district 4. According to him, there was a reduction of 66 votes belonging to PDIP (C. Result: 27,379 D. Result: 27,313), while PKB's gain increased by 95 votes (C. Result: 27,231 D. Result: 27,326). According to the Petitioner, there was an increase in PKB votes at a number of TPS in West Pasaman Regency and Pasaman Regency. Conversely, there was a reduction in PDIP votes in several TPS in the two districts.

The mistakes and errors made by the KPU have affected and harmed PDIP's legitimate votes, so PDIP filed a complaint to Bawaslu. PDIP argued that the recapitulation and counting of votes by the KPU in West Pasaman and Pasaman Districts was not honest and fair, resulting in PDIP coming in 10th place with a difference of 13 votes below PKB who won the 9th seat.

PDIP stated that based on C. Petitioner's copy of the results, they should have received 27,379 votes, while PKB received 27,231 votes, with a difference of 148 votes. Therefore, PDIP requests that the Court cancel KPU Decree No. 360 of 2024 and determine the results of the 2024 DPRD votes for West Sumatra 4 in accordance with the C. The Petitioner's copy of the results shows that PDIP obtained 27,379 votes.
