Change in Election Committee Leads to Negligence, Re-Election Required for Jayawijaya Legislative Council Members

JAKARTA (MKRI) — The Constitutional Court partially grants the Election Results Dispute Case No. 185-02-16-37/PHPU.DPR-DPRD-XXII/2024 for the candidate members of the Provincial Legislative Council of Papua Highlands, on Monday, June 10, 2024 at the MK Plenary Courtroom. The case was filed by Agus Hikman, a candidate from the Perindo Party for the Provincial Legislative Council of Papua Highlands.

"Declares that the vote acquisition results for the candidate members of the Jayawijaya Regency Legislative Council, Electoral District Jayawijaya 4 in Popugoba District, must undergo a Repeat Voting (PSU). Annuls the execution of the General Elections Commission Decision (KPU) No: 360/KPU/III/2024 on the Determination of the General Election Results for the President and Vice-President, Members of the House of Representatives, Regional Representatives Council, Provincial Legislative Council, and Regency/City Legislative Councils Nationally in the 2024 General Elections, which was announced nationally on Wednesday, March 20, 2024, at 22.19 WIB, concerning the vote acquisition for candidate members of the Jayawijaya Regency Legislative Council, Jayawijaya 4 in Popugoba District," stated by Chief Justice Suhartoyo, accompanied by eight other Constitutional Justices.


In the legal considerations read by Chief Justice Suhartoyo, the Court expressed doubts about the authenticity and validity of the documents titled “Dok. Uji Coba” submitted by the Petitioner and the photographic evidence provided by the Respondent showing the vote recapitulation and counting at the Popugoba District level. The doubts about these results, due to the replacement of the District Election Committee (PPD) members during the ongoing recapitulation process in Jayawijaya Regency, which led to changes in vote counts in Popugoba District, are legally justified.
 

"Therefore, to ensure and protect the constitutional rights of voters and uphold democratic election principles based on direct, general, free, confidential, honest, and fair principles as well as respecting the unique cultural aspects related to the noken/ikat system elections in Popugoba District, it is legally justified that the claim by the Petitioner regarding the replacement of the old PPD with a new one in Electoral District Jayawijaya 4, Popugoba District, leading to negligence/errors in vote counting by the PPD at the district and regency levels is well-founded," explained Suhartoyo.


"Therefore, to ensure and protect the constitutional rights of voters and uphold democratic election principles based on direct, general, free, confidential, honest, and fair principles as well as respecting the unique cultural aspects related to the noken/ikat system elections in Popugoba District, it is legally justified that the claim by the Petitioner regarding the replacement of the old PPD with a new one in Electoral District Jayawijaya 4, Popugoba District, leading to negligence/errors in vote counting by the PPD at the district and regency levels is well-founded," explained Suhartoyo.

"With the decision to conduct a Repeat Voting (PSU) across Electoral District Jayawijaya 4 in Popugoba District for the vote acquisition of candidate members of the Jayawijaya Regency Legislative Council, the Respondent is ordered to carry out the PSU in accordance with the statutory regulations within a maximum of 45 days from the pronouncement of the a quo decision and subsequently to establish the vote acquisition results of the PSU without needing to report back to the Court," he asserted.

Previously, the Petitioner alleged a difference in vote acquisition caused by the replacement of the old PPD with a new one in Electoral District Jayawijaya 4, particularly in Popugoba District, leading to negligence/errors in vote counting at the district level. The loss of votes through the Perindo Party in Electoral District Jayawijaya 4, namely Popugoba District, was due to errors/negligence by the PPD at the district level. Additionally, the Petitioner also claimed the disappearance of votes for filling the Legislative seat from the Perindo Party in the name of Iwan Asso totaling 3,936 votes due to errors/negligence by the PPD at the district level.
