Additional Voters' Arguments Not Proven, PAN's Petition for Central Java X Rejected

JAKARTA, MKRI - The Constitutional Court (MK) delivered during a hearing No. 83-01-12-13/PHPU.DPR-DPRD-XXII/2024 for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute. The case was petitioned by PAN (National Mandate Party) for the electoral district of Central Java X. The verdict pronouncement session was held on Friday, June 07, 2024 in the Plenary Session Courtroom.

Constitutional Justice Enny Nurbaningsih stated that the Court found that the number of voters present at TPS 008 Kendalrejo Village, Petarukan District, consisted of 171 Final Voters List (DPT) voters and 4 Special Voters List (DPK) voters. Meanwhile, at polling station 009 Kendalsari Village, Petarukan Subdistrict, there were a total of 201 DPT voters and 1 additional final voters list (DPTb) voter. In relation to the argument that there are additional voters who are not registered on the form A-Register of Transfer Voting at the two polling stations, the Court states that the argument has no basis in law.

At the Preliminary Session on Monday, April 29, 2024, the Petitioner mentioned that there was a difference in votes between the Petitioner and the PKS (Prosperous Justice Party) which affected the acquisition of the seventh seat of the House of Representatives of Central Java X by 938 votes. Therefore, the Petitioner requested that the Court order a re-voting at 8 TPS in the Central Java X constituency, which has a total DPT of 2,055. The TPS requested to conduct PSU are TPS 023 and TPS 005 Kendaldoyong Village, TPS 004 Temuireng Village, TPS 006 Karangasem Village, TPS 008 Kendalrejo Village, TPS 009 and 036 Kendalsari Village, Petarukan District, and TPS 002 Susukab Village, Comal District, Pemalang Regency, Central Java.
