Democratic Party Candidate's Allegations of Vote Inflation in Seram Bagian Timur Dismissed

JAKARTA (MKRI) - The vote acquisition numbers listed in Regency/City DPRD (Regional Legislative Council) C-Result Form in 25 Polling Stations (TPS) of Tutuk Tolu Subdistrict submitted by the General  Elections Commission (KPU) as the Respondent were the same as those proven by the Elections Supervisory Body (Bawaslu). Meanwhile, the vote acquisition numbers listed in Regency/City DPRD C-Result Form submitted by the Petitioner were different from those of the Respondent. Thus, the Court does not believe in the validity of the evidence submitted by the Petitioner to support its argument.

Thus, the legal considerations of the Court, as read out by the Deputy Chief Justice Saldi Isra, regarding the petition of Fandy Anwar Renjaan, a DPRD Candidate of Seram Bagian Timur Regency No. 7 from the Democratic Party in the Ruling Hearing for the 2024 DPR (House of Representatives) and Provincial and Regency/City DPRD election results dispute on Thursday, June 6, 2024.

In Decree No. 244-02-14-31/PHPU.DPR-DPRD-XXII/2024, the Court explicitly asserted that the Petitioner's argument, claiming that there was an addition of votes for Darwis Rumakey, Candidate No. 2, in 25 TPS spread across Tutuk Tolu Subdistrict during the certification of the vote acquisition at the Tutuk Tolu Subdistrict Election Committee (PPK), amounting to 215 votes, was not proven and must be declared legally grounded.

Furthermore, the Petitioner also argued that a witness from the Democratic Party during the recapitulation at the Tutuk Tolu Subdistrict level, Mochtar Rumalutur, who is a relative of the Relevant Party, colluded with the PPK to prejudice the Petitioner. According to the Court, continued Deputy Chief Justice Saldi Isra, this argument cannot be convincingly proven because both the submitted written evidence and witnesses fail to convince the Court of the existence of this collusion. Moreover, Mokhtar Rumalutur was not a mandated witness for the Democratic Party during the subdistrict-level recapitulation. Therefore, the Court deemed the Petitioner's argument was not legally grounded.

“[The Court] adjudicated, to reject the Petitioner’s petition in its entirety,” said Chief Justice Suhartoyo reading out the verdict of this case in the Plenary Courtroom.

During the Preliminary Hearing on Tuesday, April 30, 2024, the Petitioner mentioned discrepancies in the vote count determined by the Respondent. The Petitioner obtained 887 votes, while Darwis Rumakey, the candidate No. 2 from the Democratic Party as the Relevant Party, obtained 920 votes. However, based on the Petitioner's records, the Relevant Party should have received 705 votes, and the Petitioner should have received 888 votes. These changes and additions to the vote acquisition, continued Petitioner’s legal counsel Yandri Sudarsono, occurred in 25 TPS in Tutuk Tolu Subdistrict.

Based on these reasons, the Petitioner requested the Court to handed down a ruling to annul KPU Decree No. 360 of 2024  as it pertains to Seram Bagian Timur Regency in the electoral district of 2 for the appointment of the DPRD candidates; 25 TPS throughout the Tutuk Toli Subdistrict, Seram Bagian Timur Regency, and to certify the correct vote acquisition for the Petitioner in the appointment of the DPRD candidates for Seram Bagian Timur Regency in the electoral district of 2 from the Democratic Party as follows: Candidate No. 2 received 705 votes and Candidate No. 7 received 888 votes.
