PDIP Petition Dismissed in Four Electoral Districts, Proceedings Continue for Jambi Electoral Districts 2 and 4

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute for case No. 73-01-03-05/PHPU.DPR-DPRD-XXII/2024 on Wednesday, May 22, 2024. The case was petitioned by DPRD candidates for the electoral district of Muaro Jambi Regency 3 from the Indonesian Democratic Party of Struggle (PDI-P). 

“[The Court] adjudicated, relating to the petition’s subject matter, to rule that DPRD Jambi 3, DPRD Merangin 2, DPRD Muaro Jambi 3, and DPRD Kerinci 5 is inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.

According to the Court, the Petitioner's petition in Jambi Provincial DPRD 3, the Merangin Regency DPRD  2, the Muaro Jambi Regency DPRD 3, and the Kerinci Regency DPRD 5 contained contradictions (contradictio in terminis) in the explanation of the Posita, as well as contradictions between Posita and Petitum.

The Court adjudicated, the Petitioner's petition did not meet the formal requirements stipulated in Article 31 paragraph (2) of the Constitutional Court Law and Article 9 paragraph (2) of Constitutional Court Regulation No. 2 of 2023. Relating to the subject matter: to declare the Petitioner’s petition is vague. 

Delivering the Court’s opinion, Constitutional Justice Arief Hidayat  explained that the Petitioner's petition the Jambi Provincial DPRD for Jambi t 2 and the Kerinci Regency DPRD 4, which are also contained in the a quo petition, it will be continued in the hearing examination session with an agenda of evidence.

Previously, the Petitioner argued that there was a margin in votes between the correct number and that determined by the Respondent (KPU) for candidates of Jambi Provincial DPRD 2, Jambi Provincial DPRD 3, Muaro Regency DPRD 3, Merangin Regency DPRD 2, Kerinci Regency DPRD 4, and Kerinci Regency DPRDi 5.
