Locations Obscure, KPU Refutes PKS's Allegation in Sentani District Papua III

JAKARTA, HUMAS MKRI - The Constitutional Court (MK) held another hearing on the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) Election Results Disputes (PHPU)  on Wednesday (8/5/2024). The second hearing on the Case No. 202-01-08-33/PHPU.DPR-DPRD-XXII/2024 was filed by the Prosperous Justice Party (PKS). It was held by the Panel 2 Justices presided over by Constitutional Deputy Chief Justice Saldi Isra, accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani.

Through the Respondent's legal counsel, M. Syahwan Arey, the General Elections Commission (KPU)  presented the Respondent's response regarding the issue in Electoral District (Dapil) 3 concerning the dispute over vote acquisition in Sentani District. It was explained that Electoral District 3 has a Final Voters List (DPT) containing 134,568 voters spread across 19 districts covering 144 villages. The Petitioner only challenged the vote acquisition in Sentani District, which includes 225 polling stations (TPS). However, in their petition, the Petitioner was unable to explain the locus and forms of violations, as well as the district election committee (PPD) parties involved in cheating in Sentani District.

"The difference in calculations alleged by the Petitioner is due to incorrectly performing calculations using the Petitioner's Copy Results C, which differs from the Results C issued by the Respondent," said Syahwan.

Explanations from the Relevant Party and the Election Supervisory Agency (Bawaslu)

Through legal counsel Brodus, The Party of Functional Groups (Golkar) provided an explanation as the Relevant Party that the vote acquisition stipulated by the KPU has undergone a gradual calculation process. In this regard, Brodus clarified the vote acquisition for the Golkar and its candidates in Sentani District, identified as 6,657 votes, and the vote acquisition for the Golkar for Electoral District (Dapil) 3 is 21,369 votes.

Meanwhile, the Indonesian Democratic Party of Struggle’s (PDIP)  legal counsel, Yayang Lamhot Purba, as another Relevant Party, stated that the allegation of their party's vote increase by 783 votes in Sentani District is incorrect. "Because the accumulation of the Relevant Party's vote acquisition in Sentani District is the vote acquisition originating from each polling station (TPS) in all villages in Sentani District. Therefore, the Relevant Party states that the Petitioner's petition should be rejected in its entirety," said Lamhot.

Then, Haritje Latuihamello, in a statement from the Provincial Bawaslu of Papua, explained regarding the allegation of a discrepancy in the Petitioner's vote acquisition by 13 votes. The vote acquisition results for each party and candidate for Sentani District in the election for the Papua Provincial DPRD are based on the Model Form D. Results of the District-DPRP announced by the PPD of Sentani District. Then these results are stipulated by the Jayapura Regency KPU based on the Form D. District/Regency DPRD and Model D.Results of the City-DPRD, so that the PKS acquisition is 6,658 votes.
