JAKARTA (MKRI) — The Constitutional Court (MK) held the third workshop on the procedural law for the resolution of the 2024 general election results disputes (PHPU) for the General Elections Commission (KPU). Chief Justice Suhartoyo opened the event, which took place at the Pancasila and Constitution Education Center (Pusdik) on Monday, November 06, 2023 in Cisarua, Bogor, West Java Province.

Chief Justice Suhartoyo stated that the KPU members from various regions are crucial in facing the 2024 Election. He said no matter how well the KPU commissioners and members carry out their duties optimally from preparation to voting day, and post-voting activities, there is no guarantee that results they certify would not be brought to the Constitutional Court. Therefore, this workshop aimed to anticipate and prepare the KPU members to face election results that may be disputed and brought to the Court. Chief Justice Suhartoyo further explained that the Court’s procedure has special characteristics, so this workshop can provide knowledge to the participants regarding the legal procedure for 2024 general election results dispute (PHPU).

He said the Court proactively reaches out to justice seekers, not only by organizing workshops for election organizers but also election participants and advocates. He hoped that the presentations by the constitutional justices and the Court’s practitioners can be a very valuable reference in handling disputes over election results.

Next, in his speech on behalf of the KPU chairman, head of Legal Advocacy and Dispute Resolution Bureau of KPU RI Andi Krisna said the success of the election is determined by three elements: organizers, election participants, and citizens who have the right to vote. He mentioned that the electoral laws and regulations have provided the means to resolve conflicts between election participants and organizers, ensuring that conflicts can be resolved fairly.

He stated that the KPU, as the election organizer, has the task of coordinating, conducting, controlling, and monitoring all stages of the election. It is also obligated to carry out all stages of the election in a timely manner. The PHPU settlement mechanism has been regulated in the Election Law, and election participants can submit a petition to the Constitutional Court. Based on that, the KPU has conducted workshop in collaboration with the Constitutional Court.

Andi also reported that the PHPU workshop was attended by 160 participants from several regency/city KPUs. “The participants consist of two representatives from each regency/city KPU from the provinces of North Sumatra, DKI Jakarta, Bali, South Kalimantan, Central Sulawesi, and Southwest Papua, totaling approximately 80 regency/city KPUs,” said Andi, who mentioned that three more workshops would be conducted for regency/city KPU members.

Meanwhile, in his report, head of the Program and Implementation Division of the Pancasila and Constitution Education Center Nanang Subekti said that this workshop was based on the idea that the success of the Court’s handling of PHPU does not only rely on the readiness of the Court’s apparatuses, but also on the public’s knowledge and understanding of the 2024 PHPU.

Therefore, the Pancasila and Constitution Education Center organizes PHPU workshops for national and local political parties, presidential and vice-presidential campaign teams, election organizers, and advocates to facilitate the Court in resolving PHPU cases. This workshop was the 30th the Center had organized this year and was the KPU’s initiative.

Nanang explained the participants would receive materials on the procedural law for the 2024 PHPU; the dynamics of handling election results in the Constitutional Court; the mechanisms, stages, and schedule of the 2024 PHPU; and preparing the respondent’s response to the 2024 PHPU.
