Court Decides Tuasikal Abua-Marlatu Leleury as Head of Regional District of Central Maluku

The Constitutional Court (MK) has finally decided Tuasikal couple Abua and Marlatu Leleury as Head of Central Maluku District 2012-2017. This was conveyed by the judges final verdict in the trial case PHPU Central Maluku District - Case No. 38/PHPU.DX/2012 - on Monday (13/8) in the Meeting Room of the Constitutional Court.

 

"The verdict, judgment, states set the voting results of each Candidate in General Election 2012 Regional District of Central Maluku second round after a recount of ballots in accordance with the Constitutional Court Decision No. implementation. 38/PHPU.DX/2012, dated June 26, 2012," said Chairman of the Plenary Mahfud MD was accompanied by other constitutional judges.

 

Overall voting results after re-counting, as follows: Candidate Number 1, Drs. Jusuf Latuconsina and drg. Liliane Aitonam, as many as 87.951 (eighty seven thousand nine hundred and fifty one) votes; and Candidate Number 4, Tuasikal Abua, SH and Marlatu Leleury, SE, as many as 90.027 (nine hundred twenty seven thousand) votes.

 

In addition the Court cancel the validity of Central Maluku Regency KPU Decree on the Establishment Number 07/Kpts/KPU.Kab-MT/V/2012 Acquisition Vote Count Recapitulation Election of Regent and Vice Regent of Central Maluku District 2012 Second Round, dated May 30, 2012, and Decree Election Commission of Central Maluku regency 08/Kpts/KPU.Kab-MT/V/2012 about Stipulation No. Candidate Elected Regent and Vice Regent of Central Maluku Regency Period 2012-2017, dated May 30, 2012.

 

Court handed down a final decision after the General Election Commission ordered the Central Maluku District to conduct re-counting ballots in TPS 1, TPS 2, TPS 3, 4 TPS, TPS 5, 8 TPS, TPS 10 and TPS 12 Village Tamilouw Amahai District, in all polling stations in the Northern District of West Seram and all polling stations in the District of Teon Nila Serua.

 

In addition the Court ordered the Election Commission and the Maluku Province Election Supervisory Committee of Central Maluku regency, and the Election Supervisory Board to oversee the implementation of re-counting the appropriate authority.

 

"To be reported to the Court re-counting ballots no later than 30 days after the verdict was read. Also rejected the petition for the addition and the rest," said the judges.

 

Pursuant to Decision No, 38/PHPU.DX/2012, dated June 26, 2012, the Respondent then re-execute the vote count at the ballot box TPS 1, TPS 2, TPS 3, 4 TPS, TPS 5, 8 TPS, TPS 10 and TPS 12 Village District Tamilouw Amahai, all polling stations in the Northern District of West Seram, all polling stations in the District Teon Serua Nila on July 2, 2012 until the date of July 4, 2012.

 

Furthermore, the Respondent expressed Report Ballot Re-Count set forth in a written report No.94/KPU-Kab/029.433639/VII/2012, dated July 4, 2012, and communicated orally before the court on August 7, 2012, which essentially are as follows: Central Maluku Regency on June 28, 2012 issued a decree on the Implementation Schedule Birthday Ballot Counting Election of Regent and Vice Regent of Central Maluku District in 2012 at all polling stations in the District of TNS, the entire North West Seram district, and eight TPS Tamilouw Village, District of Amahai.
