Consider constitutional right to be elected by the KIP Aceh City, Will Candidate Pair of Mayor and Deputy Mayor of Banda Aceh Ayiub Ahmad suing the city of Banda Aceh elections to the Constitutional Court (MK). The first session of the agenda the improvement examination is chaired by Deputy Chief Justice of the Constitutional Court Ahmad Sodiki on Thursday (3/5) at the Plenary Room.

In the main petition, the Petitioner objected to the city of Banda Aceh KIP Decree Number 54 Year 2012 regarding the establishment candidate mayor and deputy mayor of Banda Aceh Year 2012. The applicant is a pair of candidates who apply after the decision of the Court dated January 16 1/SKLN-X/2012 No. 012 by using an independent path. Through their attorneys, Syafaruddin, the applicant has to register as candidate mayors and deputy mayor of Banda Aceh on January 24, 2012. On that occasion, the Petitioner also submitted evidence of support needed in the filing as independents as much as 8465 pieces of ID cards from 6822 pieces minimum support ID cards. However, through the stages of verification support applicant declared ineligible.

 "The applicant has been registered and are qualified administrative exist. Even the applicant has followed the medical examination and tests read Al-Qur` an. In the first stage of factual verification, proof of support from as many as 8465 pieces of Applicant identification documents that support otherwise meet the shortage of Personality and 4320 as many as 2502 pieces of sheet and have met twice, the ID card backing sheet 5004. The applicant has submitted additional evidence of support for ID card backing sheet 5364, but received 5004 pieces and the rest rejected. In the second stage of verification, support for the Petitioner ID cards is verified for 2212. This is just a trick of the Respondent, "explained Syafaruddin Assembly before the Constitutional Court.

The applicant also states rejected the Respondent to pay Rp 20 million to pass the verification. The applicant considers that it would injure the principles of the General Election. The petition also, the Petitioners feel cheated by the city of Banda Aceh KIP with the release of the minutes of the establishment candidate in the 2012 General Election City of Banda Aceh. "The applicant has also been reported to the Election Supervisory Committee and followed up with a reason not to lack of evidence. Respondent’s actions have prevented the Petitioner’s constitutional rights as citizens. For this reason, we ask that the Court schedule a re-vote again on Election Banda Aceh," he explained.

Constitutional judges are also members of the Constitutional Court Ahmad Fadlil Sumadi and Harjono to suggest improvements to the Applicant. According Fadlil, Petitioner reasons less complete petition. "You have 8465 ID postulates, but is otherwise lacking verifiable ID 2212. You should include how the Respondent informed the shortfall? Then, return the evidence supports the Respondent Petitioner, then why can it be restored? Been handed KTP 5354, but received only 5004 pieces. It returned later questioned why?" Fadlil said.
