REVISED PETITION CONCERNING THE DISPUTE ON THE AUTHORITIES TO NOMINATE THE ELECTED REGENT/DEPUTY REGENT OF SOUTHEAST ACEH
The Constitutional Court held the second hearing for examining the case of Dispute on the Authorities of State Institutions filed by the Independent Election Commission (KIP) of Southeast Aceh Regency as Petitioner I and the Regional Peopleââ¬â¢s Legislative Assembly of Southeast Aceh Regency as Petitioner II at the Constitutional Courtââ¬â¢s courtroom on Monday (19/11) at 10.00 West Indonesia Time scheduled for the Examination of the Revised Petition. In this case the Petitioners filed the petition against the Independent Election Commission of Nanggroe Aceh Darussalam Province as Respondent I, the Governor of Nanggroe Aceh Darussalam Province as Respondent II and the President of the Republic of Indonesia c.q. the Minister of Home Affairs of the Republic of Indonesia as Respondent III.
The revised petition was read by O.C. Kaligis c.s. as the Petitionersââ¬â¢ Attorneys. The Petitioners has cancelled one out of the ten claims originally filed, namely the one requesting the Panel of Constitutional Court Justices to order Respondent III to revoking Decree of the Minister of Home Affairs No. 131.11-347 Year 2007 regarding Dismissal of the Acting Regent and Approval of the Appointment of Ir. H. Hasanuddin B., M.M. as Regent of Southeast Aceh Regency of Nanggroe Aceh Darussalam Province for term of office 2007-2012 and Decree of the Minister of Home Affairs No. 131.11-348 dated July 30, 2007 concerning Approval of the Appointment of Drs. H. Syamsul Bahri as Deputy Regent of Southeast Aceh Regency of Nanggroe Aceh Darussalam Province for term of office 2007-2012.
In addition, in the statement of claims of their revised petition, the Petitioners have revised their petition by declaring that it is Petitioner II that has the authority to nominate the elected Regent/Deputy Regent of Southeast Aceh.
With respect to the revision, the Panel of Constitutional Court Justices declared that it can accept the petition of the Petitioners and endorsed seventeen evidence listed by the Petitioners. The Examination of Revised Petition of this case was conducted by a Panel of Constitutional Court Justices chaired by Maruarar Siahaan with Mukthie Fadjar and Soedarsono as members and assisted by Cholidin Nasir as Substitute Registrar.
